1)IssueofLotCoveragefor13Lots(Lot5andLots8through19): <br />TheApplicant’sdesiretoincludelargeamountsofpreservationareaintopartoftheland <br />conveyedtosomelotowners(whattheApplicationcalls“IndividualPreservationAreas)isill- <br />conceived.Thirteenlotscontainso-calledIndividualPreservationAreas(Lot5and8through <br />19).Thesearesomeoftheissues: <br />a.Asdiscussedinnumerousareaswithinthisresponse,theseso-calledIndividualPreservation <br />Areasareextremelysteep,heavilywoodedandunsafe.Itisnotusableland. <br />b.Theso-calledIndividualPreservationAreasrangeinareafromquitesmall(approx.1,120 <br />SF)tosubstantial(17,742SF).Theseareasareattheveryeastsideoftheproposedproject, <br />asitdropsofftotheRibbonTrail.TheCommitteeestimatesthattheslopeoftheareas <br />rangesfrom32%to46%,withanaverageslopeof38%.Again,thislandisnotusable. <br />c.However,theApplicationhasfoundsome usesforthislandonpaper.Becausethisland <br />willbedeededtothelotownersandispartofthepurposedtaxlots,theCitywillincludethis <br />landinitscalculationofallowablesitecoverage.A50%lotcoverageratiowillbeappliedto <br />alllots.(SeealsosummarydiscussionofLots16and17belowandintheSectionaddressing <br />theApplication’srequestforflexibilityunder EC9.2750LotCoverage attheendofthis <br />discussionofCriterion10. <br />Forthe13lotsincorporatingso-calledIndividualPreservationArealandwithintheirboundaries, <br />allowablesitecoverageonthebuildableportionofthelotwillbefargreaterthan50%-evento <br />thepointofcoveringtheentirebuildableportionofthelot. <br />Thisanomalycould,theoretically,beachievedbecausewhencalculatinglotcoverageat50%, <br />theunusablelandwillbeincludedinthetotallotsquarefootagenumberinthecalculation.See <br />calculationexampleimmediatelyfollowing.(SeealsospreadsheetattachedasAttachmentI.) <br />TheleastimpacttoactualallowablecoverageonthebuildableportionoflotswillbeforLot5 <br />becauseitonlyhas1,117SFofso-calledIndividualPreservationArea.Lot5totals17,735SF, <br />withnetbuildableshownat16,459SF.Calculating50%ofthetotallotareausingthe17,735SF <br />indicatesthat8,868SFofbuildingfootprintwouldbeallowedonthe16,459SFnetbuildable <br />area(50%x17,735SF=8,868SF).Therefore,thecoverageratioonthenetbuildableportionof <br />thelotwouldactuallybecloserto54%.(8,868SFallowablebldg.footprintdividedby16,459 <br />SFbuildablearea=54%).Nottooegregious. <br />However,whenthissamemathisappliedtolargerlotswithsubstantialso-calledIndividual <br />PreservationAreasincluded,theresultsareastounding!Forinstance: <br />Lot8coveragecouldbeabout62%; <br />Lot12coveragecouldbeabout91%;and <br />Lot19coveragecouldbeabout109%. <br />131 <br /> <br />
