“domesticandfireflows.”Thetimeframeforcompletionofaone-tothree-milliondollarcapital <br />projectcannotbeanticipatedatthispoint.Eventually,asignificantportionofsuchcostswould <br />berecoupedunwittinglyfromallEWEBratepayersandthepurchasersofproposedCHPUD <br />lots.\[SeeEWEBRestrictiveCovenantletter,AttachmentF\] <br />Thus,(1)“moreefficientenergyuse”isfalsebecauseadditionalenergywouldbeneededto <br />expandcapacityandthenuseofthisincreasewouldonlybenefittheresidentsoftheproposed <br />CHPUD\[Seebelow EC9.8320(1)PolicyA.10 and EC9.8300(1)(a),(e)\];(3)“useofvacant <br />leftoverparcelswhereutilitiesarealreadyinplace”isadeceptiveassertionbecauseutilitiesare <br />onlyoperativeonthreelotsandexistingcapacityisjudgedbyEWEBtobeinadequatetoserve <br />theproposedCHPUD;(4)“moreefficient,lesscostlyprovisionofutilitiesandservicestonew <br />areas”isnowobviouslyrenderedfalse,giventhecurrentconditionsdiscussedabove. <br />For(2)“preservationofthemaximumamountofproductiveagriculturalland,”wewillargue <br />belowthatthisclaim,inrelationtotheUGB,ishypotheticalandcannotbemeasured(whatdoes <br />“maximum”mean?)NotethattheApplication’sconcluding“importantobjectives,”restatethe <br />fouritems–butomitthequalification“whereutilitiesarealreadyinplace.”Thus,Application <br />doesnotsubstantiateitsclaimthattheproposedCHPUD“isanappropriateinfilldevelopment <br />withintheUGB”(p.20of67).WewilldiscussissuesrelatedtotheUGBbelowunder PolicyA. <br />10 and EC9.8300(1)(e). <br />ResidentialLandUseandHousingElement <br />PolicyA.10PromotehigherresidentialdensityinsidetheUGBthatutilizes <br />existinginfrastructure,improvestheefficiencyofpublicservicesandfacilities, <br />andconservesruralresourcelandsoutsidetheUGB. <br />TheCHPUDResponseCommitteehasagreedwiththeaimofincreasingresidentialdensity <br />withinthecity,toreducepressuretoexpandtheUGB,withouthavingtoagreethatanyandall <br />infilldevelopmentshouldbeapproved–especiallyoneinasensitivelocationliketheproposed <br />CHPUD.Asageneralprinciple,atthemacro-level,itisreasonabletopromotegreaterhousing <br />densityfromurbaninfillinordertoachieveeconomiesofinfrastructureandservice(asstatedin <br />PolicyA.10).However,itshouldnotbeassumedthattherewouldbeacorrelationor <br />equivalencybetweenanyonePUDdevelopmentproposalandanyruralresourcelandconserved <br />beyondtheUGB.RegardingtheproposedCHPUD,Applicationoffersonlyassertionswithout <br />anyspecificevidencetoclaimthatthisdevelopmentwouldpositivelysaveruralresource(e.g., <br />agricultural)landsor,iftheproposalweredenied,suchlandswouldbenegativelyimpacted. <br />TheproposedPUDwouldnotbeanurbaninfillmadeup“ofvacantleftoverparcelswhere <br />utilitiesarealreadyinplace,”aswehaveshownabove.ThusclaimsthattheproposedCHPUD <br />“utilizesexistinginfrastructure,improvestheefficiencyofpublicservicesandfacilities”are <br />invalid.Ratherthanutilizingandimprovingefficiencies,theproposedCHPUDwouldrequire <br />extensiveandexpensiveincreasesandextensionsofinfrastructuretoservethehigherdensity. <br />Accordingly,thefollowingclaimsintheApplicationarenowrenderedfalse:“existing <br />infrastructurewillbeutilizedbyahighernumberofresidentsandgreaterefficiencieswillbe <br />createdby...proximitytoexistingfacilities”(p.20of67). <br />6 <br /> <br />
