Howdoesthereaderdeterminewhichistheappropriatetermtouse,whentheauthorcannotdo <br />so?Withthislackofuniformity,whichtermdoestheApplicationusetodescribethemostspace <br />(notforresidentialconstructionorroads)onthesiteplan? <br />The8/22/17Applicationutilizestheterminology“CommonOpenSpace”withanarrowpointing <br />toTractAonthe1/19/18SitePlanL6.0.“CommonOpenSpace”isalsousedtodescribeTracts <br />CandDonthesesameplans.Infact,thevariousiterationsofsiteplanssince3/3/17haveall <br />usedthisdescriptiveterminologytodescribeTractsA,CandD. <br />The8/22/17Application,(p.26of67)brieflydiscussestheareasdedicatedtopreservationas <br />follows: <br />“Alargearea(TractA)ispreservedaspartofthisproposal…Thisapproximately2.33acre <br />pieceprovidesanareathatpreservesexistingvegetationandensuresacontinuousvisual <br />bufferbetweentheRibbonTrailandthesubjectproperty.Moreover,therewillbeportions <br />ofeachindividualtaxlotthatarealsorequiredtobepreservedwithrespecttohealthytrees <br />andvegetation.ThispreservationareadirectlyabuttingtheRibbonTrailamountsto2.08 <br />acres.Inadditiontoothersmallpreservationareasscatteredthroughoutthesite,thisbrings <br />thetotalpreservationareatoapproximately4.54acres.”(Emphasisadded.) <br />NotethattheCommitteefindsthreeincorrectstatementsintheshortparagraphquotedabove: <br />1)ThereareNOTportionsofeachindividualtaxlotrequiredtobepreserved.Only13lots <br />(38%ofthetotal34lots)containapreservationarea; <br />2)The2.08acresofpreservationareadescribedaboveDOESNOTdirectlyabuttheRibbon <br />Trailarea.TractA(2.33acres)istheportionofpreservationareathatdirectlyabutsthe <br />RibbonTrailarea. <br />3)Thelanguage“…othersmallpreservationareasscatteredthroughoutthesite”impliesa <br />numberofareasinanumberofplaces.Infact,thereareonlytwosuchareas(TractC-1,140 <br />SFandTractD-2,426SF).Theyarenot“scatteredthroughoutthesite.”Theyarelocated <br />attheproject’sentrance(acrossfromeachother)andwillserveasalandscapedsignagearea. <br />TheResponseCommitteereiteratesitsfrustrationwithdiscrepancies.TheCommitteehas <br />compiledalistofmorethan60discrepanciessuchasthese(AttachmentE). <br />Thesethreeaboveerrorsnotwithstanding,itisevidentfromtheabovethatthese4.54acresare <br />slatedforpreservationandarewhattheaveragecitizenwouldusuallyrefertoas“Common <br />OpenSpace.” <br />Furthermore,ECSection9.0500(“Definitions”)doesnotcontainadefinitionforthe <br />Application’sterminology“PreservationArea”or“IndividualPreservationArea.” <br />However,EC9.0500(“Definitions”)doesdefine“CommonOpenSpace,”whichistheterm <br />thattheCommitteehaspreviouslynotedpertainstothemajorityofthelanddescribedbythe <br />Application. <br />96 <br /> <br />
