Received in Public Hearing <br />City of Eurlene Planning & Development <br />Capital Hill PUD testimony <br />MAR 07 2018 <br />file PDT r7- <br />My name is Mark Conley. I am located near the proposed development. I am <br />opposed to this development entirely. I open my testimony quoting Attorney <br />Thomas Berry with regard to property and development rights: <br />"Human rights do not cancel out the rights of other modes of being to exist in <br />their natural state. Human property rights are not absolute. Property rights are <br />simply a special relationship between a particular human "owner" and a <br />particular piece of "property," so that both might fulfill their roles in the great <br />community of existence." <br />I believe that the developer, and City of Eugene Planning Department, by <br />ignorance and omission, respectively, are not paying attention to the rights of <br />other beings - plant, animal, and human neighbors and hikers - in this <br />development. <br />Specifically, <br />Ridgeline vegetation and native communities are rarer and fragile. <br />Oak, Madrone, Stellers Jay and associated birds, Deer families, especial <br />Western Swordfern grotto, Hairy Honeysuckle, Tiger Lily, Great Hounds <br />Tongue and rare plants such as Fairy Slipper Orchid, must all be studied and <br />protected. There may also be endangered plants and animals. This area must <br />be studied and fully documented for a full year. <br />Development approval ignores the rights of the many, who hike, live in this <br />area, and find exceptional peace in the midst of urban development, and <br />commune with these fragile and ephemeral beings. Our rights supersede the <br />few, who by greed and ignorance, seek to take and erase forever this <br />irreplaceable beauty, sovereignty, and unique genetic message for the <br />temporary benefit of the elite moneyed few. <br />These reasons are compelling. You must deny this application. If current <br />planning code does not address what I have just uttered, it needs to be <br />immediately updated and applied to this development proposal. Thank you. <br />
