EugeneOrdinanceExhibitE <br />\[LaneCountyOrdinanceExhibitA\] <br /> <br />35 micrograms per cubic meter, within the Eugene Urban Growth Boundary. <br /> Subsection (1)(d) and the lead in paragraph of subsection (2) of Section <br />6.320 of the Eugene Code, 1971, are amended to provide as follows: <br />6.320 Criteria for Permit Issuance <br />. <br />(1) <br /> The city manager or designee shall approve, approve with conditions, or deny <br />a permit application based on consideration of the following criteria: <br />(d) The necessity to remove trees in order to construct proposed <br />improvements, or to otherwise utilize the applicant's property in a <br />manner consistent with its zoning, this code, the comprehensive plan, <br />and other applicable adopted plans; <br />(2) <br /> In the event a plot plan for full development of the site has not been approved <br />by the city, felling of trees shall be permitted only on a limited basis consistent <br />with the preservation of the site's future development potential and <br />preservation of important natural values as prescribed in the comprehensive <br />plan and this code, and consistent with the following criteria: <br /> <br /> <br /> Subsection (2) of Section 7.715 of the Eugene Code, 1971, is amended <br />to provide as follows: <br /> <br />7.715 SDC - Compliance With State Law <br />. <br />(2) <br /> The capital improvement plan required by state law as the basis for expending <br />systems development charge revenues for capital improvements shall be the <br />Eugene Capital Improvements Plan (CIP) and the comprehensive plan as <br />adopted by the council (Plan), other city facilities plans that may include SDC- <br />eligible capital projects, or the capital improvement plan adopted by another <br />governmental body which was used by the city manager in establishing the <br />methodology for the systems development charge, provided such capital <br />improvement plan is consistent with the CIP and the Plan. <br /> <br /> <br /> The lead in paragraph of subsection (1) of Section 9.0020 of the Eugene <br />Code, 1971, is amended to provide as follows: <br />9.0020 Purpose. <br />The purpose of the land use code is to protect and promote the health, <br />safety, and general welfare of the public and to preserve and enhance the <br />economic, social, and environmental qualities of the community. <br />(1) <br />The land use code is intended to effectively and efficiently implement <br />applicable state and federal laws, the Envision Eugene Comprehensive Plan, <br />the Metro Plan, and the following policies from the Growth Management <br />Study: <br /> Definitions for ÐComprehensive PlanÑ and ÐEnvision Eugene <br />Comprehensive PlanÑ are added in alphabetical order to Section 9.0500 <br /> Page 2 of 38 <br />Final <br /> <br />
