the Eugene Code, would they not have to apply but could cut down trees in this area because doing so was part of a approved
PUD plan? How does tree removal work in the Discretionary Area if the PUD is approved?
Question 2) The applicant has identified trees in "Conservation Areas" on private property. 401 trees, to be specific.
Subsequent to an approval of the PUD, what code or regulation regulates the cutting of the trees in the Conservation Areas
that are on private property? Property owners could cut five trees a year in this area? Would they need to obtain permits
from the city to cut one or more trees? If so, would the Tree Preservation Plan and Conservation Plan determine approval or
denial of a permit to cut trees in a Conservation Area? Or would these areas be treated as normal private property by the city?
In other words, what is to prevent trees in the Conservation Area from being cut by future lot owners?
Thanks for your help. Best, Jason
Jason Brown
Associate Professor of Creative Writing
University of Oregon
(917) 767-5386
