Persons who appeared.before the local <br />government orally or in writing may appeal the decision to the Oregon. Land Use Board of Appeals within 21 <br />days of the Hearings Official's decision. Appeals to the Oregon Land Use Board of Appeals are governed by <br />ORS 197.805 to 197.860 and OAR Chapter 661,. Division 10. <br />Why is the. Hearings Official accepting new evidence and argument? <br />To obtain a full approval of the proposed planned unit development (PUD) the applicant must receive <br />approval of both its tentative PUD plan and its final PUD plan. The final PUD plan must "match" the approved <br />tentative PUD plan and any conditions of approval attached to the tentative PUD plan. The City approved - <br />both the tentative and final PUD plans, but legal challenges regarding both decisions were filed with the Land <br />Use Board of Appeals (LUBA). The City's decision on the applicant's tentative PUD application was remanded <br />back to the City, resulting in a change to the tentative PUD approval. The parties to the final PUD appeal <br />agreed to voluntarily remand the final PUD decision back-to the City so that the City could consider the final <br />PUD application in light of the revised tentative approval. <br />Where to Find More Information <br />'The record of materials for this application is available for inspection at the Planning Division at no charge at <br />the Permit and Information Center in the Atrium Building, 99 West 10th Avenue, between 9 a.m. and 4 p.m., <br />Monday through Friday.
