would need to pull over on or traverse a gravel or dirt surface, as opposed to a paved surface if there is <br />vehicular traffic on Oakleigh Lane. The PC finds that the increase in daily vehicle,-pedestrian and bicycle <br />trips from the proposed development, paired with the current state of Oakleigh Lane (where paving is <br />approximately 14 feet in width at some locations), will create an environment that is not safe for <br />pedestrians and bicyclists to access nearby residential areas, transit stops, and neighborhood activity <br />centers. <br />Based on the above findings, the PC finds that a condition of approval is necessary to increase the <br />l <br />paving width along Oakleigh Lane so that it is at least 20 feet to accommodate the vehicular travel lane <br />and intermittently parked vehicles and still provide safe passage for pedestrians and bicycles. The <br />following condition of approval is required to ensure a safe and adequate transportation system for all <br />modes of travel: <br />Prior to occupancy of any dwellings in the PUD, the applicant shall improve Oakleigh Lane to <br />ensure a minimum of 20 feet of paving width, in any areas where the paving width is currently <br />less than 20 feet within the existing right-of-way. The applicant shall obtain any necessary <br />permits for the required street improvements, and shall provide documentation of compliance <br />upon completion. <br />Based on these findings and new condition of approval, the pedestrian, bicycle and transit circulation <br />requirements of EC 9.8320(5)(b) are met. <br />Constitutional Findings for Required Improvement <br />It 'is in the public interest to have Oakleigh Lane consist of at least 20 feet of paving width within the <br />dedicated right of way in order to ensure safe and adequate bicycle and pedestrian circulation to <br />residential areas, transit stops, and neighborhood activity centers, adjacent to and nearby the <br />development site. <br />There is a nexus between the requirement to improve Oakleigh Lane to a minimum 20 feet and the <br />public interest at issue. EC 9.8230(5)(b) requires that the PUD provide safe and adequate transit <br />systems, including bicycle and pedestrian circulation both within the PUD itself and as necessary to <br />access adjacent and nearby residential areas, transit stops, neighborhood activity centers. A minimum <br />of 20 feet of paving width will allow pedestrians and bicycles to more safely utilize Oakleigh Lane to <br />access River Road and the associated residential areas, transit stops, and other facilities to the west of <br />the PUD. <br />The requirement to improve Oakleigh Lane to 20 feet of paving within the dedicated right of way is <br />roughly proportional to the impact that the proposed development will have on the City's <br />transportation facilities. The proposed development will result in 29 new-residential units. These <br />residential units will be accessible only from Oakleigh Lane. Currently, 25 lots, consisting of a mix of <br />residential, general office and commercial zoning have structures that take access onto Oakleigh Lane; <br />thus the additional 29 residential units will increase the number of structures that access Oakleigh Lane <br />by over 100 1 percent.
