the Fire Marshal did not identify a significant risk to emergency response actions, and found that due <br />to improvements including installation of a fire apparatus access road turnaround that eliminates a <br />dead end situation, "[t]he proposed development accounts for actual safety improvements regarding <br />emergency response for both fire related and medical related responses." The PC finds this as <br />supplemental evidence that supports the PC's previous finding that the PUD itself would not be a <br />significant impediment to emergency response. <br />Constitutional Findings for Required Improvement <br />It is in the public interest to have Oakleigh Lane consist of at least 14 feet of paving width within the <br />dedicated right of way in order to ensure unimpeded emergency response to the existing residents of <br />Oakleigh Lane and the future occupants of the proposed PUD. <br />There is a nexus between the requirement to improve Oakleigh Lane to a minimum. 14 feet and the <br />public interest at issue. The adopted Design Standards and Guidelines for Eugene Streets, Sidewalks, <br />Bikeways and Accessways provide minimum street standards for low volume residential streets such as <br />Oakleigh Lane. For streets with traffic volumes less than 750 vehicles per day, the Design Standards <br />and Guidelines allow for a minimum 14-foot travel lane. By requiring a minimum 14 feet of paving <br />width, the PC will ensure compliance with adopted minimum travel lane width and the provision of <br />unimpeded emergency response. <br />The requirement to improve Oakleigh Lane to 14 feet of paving within the dedicated right of way is <br />roughly proportional to the impact that the proposed development will have on the City's <br />transportation facilities. The proposed development will result in 29 new residential units. These <br />residential ;units will be accessible only from Oakleigh Lane. Currently, 25 lots, consisting of a mix of <br />residential, general office and commercial zoning have structures that take access onto Oakleigh Lane; <br />thus the additional 29 residential units will increase the number of structures that access Oakleigh Lane <br />by over 100 percent. The construction of the new structures will result in an increase of vehicular <br />traffic onto Oakleigh Lane by approximately 168 new vehicular trips per day. See Trip Generation <br />Manual from Institute of Transportation Engineers (ITE) for Residential Condo/Townhouses (Category <br />230). <br />The record shows that there is already 14 feet of paving within the dedicated right of way for almost <br />the entire length of Oakleigh Lane. The requirement to improve Oakleigh Lane to 14 feet amounts to <br />an improvement of very small fraction of the entire length of Oakleigh Lane. Given that the proposed <br />PUD will generate an additional 168 new trips on Oakleigh Lane, and given the small amount of <br />improvement, if any, that will be necessary, the requirement to improve Oakleigh Lane to a minimum <br />of 14 feet within the right of way is roughly proportionate to the impact the proposed development <br />will have on the City's transportation facilities. <br />The PC notes that compliance with the condition of approval for at least 20 feet of paving width within <br />the right-of-way of Oakleigh Lane, imposed by the PC in response to the "Second Assignment of Error," <br />will necessarily also result compliance with the condition of approval of 14 feet of paving width <br />imposed in response to this third assignment of error. <br />Based on these findings, the conditions imposed by the HO, the condition of approval above, and the <br />condition of approval imposed by the PC in response to the second assignment of error, the PC finds <br />2017 Final Order: Oakleigh Meadows Co-Housing PUD (PDT 13-1) Page 10 <br />
