Lane County Ordinance <br />Residential Land <br />Boundary ("the Eugene urbanizable area"). However, the findings in that Element <br />of the Metro Plan are no longer applicable within the Eugene urbanizable area. An <br />amendment is made to the first paragraph under Section A in Chapter III of the <br />Eugene-Springfield Metropolitan Area General Plan (with no changes to the <br />footnote) as follows: <br />A. Metropolitan Residential Land Use and Housing Element <br />The Metro Plan Residential Land Use and Housing Element addresses the <br />housing needs of current and future residents of the entire Eugene-Springfield <br />metropolitan area through 2015. In 2011, the City of Springfield and Lane County <br />adopted a Residential Land Use and Housing Element that addresses Springfield's <br />city-specific residential land needs through 2030.13 In 2017, the City of Eugene <br />adopted the Envision Eugene Residential Land Supply Study to address <br />Eugene's city-specific residential land needs through 2032. These city- <br />specific actions were based on the mandates set out in ORS 197.304, described <br />in more detail in the Metro Plan Preface and Chapter 1. In adopting its city-specific <br />update in 2011, Springfield made it clear that the regional housing goals and <br />olicies in this Metropolitan Residential Land Use and Housing Element would <br />continue to apply to Springfield. However, the finding s in this Metro Plan element <br />no longer apply on the east side of Interstate 5. In adopting its city-specific <br />actions in 2017, Eugene also made it clear that the regional goals and <br />policies in this Housing Element would continue to apply to Eugene, but the <br />findings would no longer apply within Eugene. <br />2. Only to the extent applicable within the Eugene urbanizable area, the Envision <br />Eugene Comprehensive Plan is amended as follows: <br />(a) The Introduction text of the Eugene Urban Growth Boundary chapter is <br />amended as shown on Exhibit A-1 to this Ordinance. <br />(b) The Envision Eugene Residential Land Supply Study attached to this <br />Ordinance at Exhibit A-2 is adopted by Lane County as Appendix C to the Envision <br />Eugene Comprehensive Plan solely to support the actions taken by this Ordinance. <br />This Study is not applicable to and is not intended to provide support for County <br />actions in other areas in Lane County. <br />3. Policies and plan designation amended by this Ordinance remain in force to <br />authorize a punishment, penalty or forfeiture incurred, or a suit, prosecution or <br />proceeding pending when the amendment takes effect, for an offense or violation <br />committed under the amended Ordinance or regulation prior to the effective date <br />of this Ordinance. <br />4. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance <br />is for any reason held invalid or unconstitutional by any court of competent <br />jurisdiction, such portion constitutes a separate, distinct and independent <br />provision, and such holding does not affect the validity of the remaining portions <br />hereof. <br />Ordinance - Page 2 of 3 May 2017 <br />
