Public Notice/Referrals <br />Consistent with EC 9.7007 Neighborhood/Applicant Meetings, a required neighborhood- <br />applicant meeting complying with the requirements of the Eugene Code was held on December <br />20, 2016. <br />Public notice of the application was mailed on April 14, 2017, and posted consistent with the <br />requirements of EC 9.7210. The Planning Division received testimony from Kristen Okray, Orin <br />Schumacher, Jens Inge Egeland, and I-Brooks. None of the concerns raised appear to relate to a <br />specific approval criterion or standard, rather the focus is on a desire to preserve habitat for <br />wildlife, a concern that there has not been sufficient public process, and statements that no <br />more housing is needed in the area in question. The concerns raised by the testimony are <br />understandable, however, approval of a subdivision involves only the division of land and <br />assures that a site is buildable, serviceable and meets the applicable standards of the Eugene <br />Code. <br />Referral comments were also provided by various City staff, and other service providers. Those <br />comments are addressed in the following evaluation with respect to applicable approval criteria <br />and are included in the application file for reference. Additional informational items are also <br />attached to the end of this report for the applicant's benefit. <br />Tentative Subdivision Evaluation <br />The following findings, with the conditions of approval as described, demonstrate that the <br />proposed tentative subdivision plan will comply with all applicable approval criteria. The <br />approval criteria are listed below in bold, with findings addressing each; various conditions of <br />final plat approval and informational items are included where appropriate. <br />EC 9.8520(1): The applicant has demonstrated that the proposed housing is needed <br />housing as defined by State statutes. <br />Oregon Revised Statutes define needed housing as follows: <br />197.303 Needed Housing Defined <br />(1) As used in ORS 197.307 (Effect of need for certain housing in urban growth areas), <br />needed housing means housing types determined to meet the need shown for <br />housing within an urban growth boundary at particular price ranges and rent levels, <br />including at least the following housing types: <br />a) Attached and detached single-family housing and multiple family housing for <br />both owner and renter occupancy, <br />b) Government assisted housing; <br />c) Mobile home or manufactured dwelling parks as provided in ORS 197.475 (Policy) <br />to 197.490 (Restriction on establishment of park); <br />d) Manufactured homes on individual lots planned and zoned for single-family <br />residential use that are in addition to lots within designated manufactured <br />dwelling subdivisions; and <br />e) Housing for farmworkers. <br />Wendell Canyon (ST 17-4) May 2017 Page 2 <br />
