Within the /WR Water Resources Conservation Overlay Zone, no <br />new lot may be created if more than 33% of the lot, as created , would <br />occupy either: <br />1. The combined area of the /WR conservation setback and any <br />portion of the Goal 5 Water Resource Site that extends landward <br />beyond the conservation setback; or <br />2. The /WQ Management Area. <br />• Subsections (1), (2) and (4)(b) of Section 9.8325 of the Eugene Code, <br />1971, are amended to provide as follows: <br />9.8325 Tentative Planned Unit Development Approval Criteria - Needed Housina. The <br />hearings official shall approve, conditionally approve, or deny the PUD application <br />with findings and conclusions. Unless the applicant elects to use the general criteria <br />contained in EC 9.8320 Tentative Planned Unit Development Approval Criteria - <br />General, where the applicant proposes needed housing, as defined by the state <br />statutes, the hearings official shall approve or approve with conditions a PUD based <br />on compliance with the following criteria: <br />(1) The applicant has demonstrated that the proposed housing is needed housing <br />as defined by state statutes. <br />(2) The proposed land uses and densities within the PUD are consistent with the <br />land use designation(s) shown on the rMetF„ DlaR aRd Use DiagFa,,] <br />comprehensive plan diagram, as refined in any applicable refinement plan. <br />(4) For areas not included on the city's acknowledged Goal 5 inventory, the PUD <br />preserves existing natural resources by compliance with all of the following: <br />(b) Natural resource areas designated on the [ -e° ] comprehensive <br />plan diagram as "Natural Resource" are protected. <br />• Section 9.8421 of the Eugene Code, 1971, is amended to provide as <br />follows: <br />9.8421 Purpose of Refinement Plan Amendments. An amendment to an existing <br />refinement plan allows changes to be made to portions of the plan without <br />comprehensively updating the entire document. Refinement plan application <br />requirements and criteria are designed to facilitate consideration of amendments to <br />address changes that have occurred, such as changes in state or federal legislation, <br />changes in the comprehensive plan or other applicable local policies, <br />or changes in circumstances that could directly influence public policy choices. <br />• Subsection (1) of Section 9.8424 of the Eugene Code, 1971, is <br />amended to provide as follows: <br />9.8424 Refinement Plan Amendment Approval Criteria. The planning commission shall <br />evaluate proposed refinement plan amendments based on the criteria set forth <br />below, and forward a recommendation to the city council.
