Eugene Ordinance Exhibit E <br />[Lane County Ordinance Exhibit F-3] <br />Table 9.8010 List of Adopted Plans <br />19th and Agate Special Area Study Willow Creek Special Area Study <br />• Section 9.8030 of the Eugene Code, 1971, is amended to revise <br />subsection (24) and to add a new subsection (36) provide as follows: <br />9.8030 Adjustment Review - Approval Criteria. The planning director shall approve, <br />conditionally approve, or deny an adjustment review application. Approval or <br />conditional approval shall be based on compliance with the following applicable <br />criteria. <br />(24) Stormwater Quality, Flow Control, Oil Control and Source Control Standards <br />Adjustment. (Adjustments under this subsection are not permitted within <br />the /CL Clear Lake Overlay Zone.) <br />(36) /CL Clear Lake Overlay Zone. Where EC 9.4165 provides that the <br />development standards of the /CL Clear Lake Overlay Zone may be <br />adjusted, approval of the request shall be given if the applicant <br />demonstrates consistency with all of the following: <br />(a) The Purpose of the zone (EC 9.4150); <br />(b) Development impacts will have negligible effects on school and <br />park users, surrounding residents, and the environment, and <br />alternative mitigation measures will be employed to offset the <br />proposed adjustment, <br />(c) Development will increase access to open space and improve <br />ecological functions of natural features on-site; <br />(d) Development is consistent with local and regional economic <br />development goals (e.g., it is one of the targeted industries from <br />the City's Economic Opportunities Analysis or Regional Prosperity <br />Plan (2010)). <br />• Subsection (2) of Section 9.8065 of the Eugene Code, 1971, is <br />amended to provide as follows: <br />9.8065 Code Amendment Approval Criteria. If the city council elects to act, it may, by <br />ordinance, adopt an amendment to this land use code that: <br />(2) Is consistent with applicable provisions of the [^n°°+n] comprehensive <br />plan and applicable adopted refinement plans. <br />• Sections 9.8070, 9.8072, 9.8073 and 9.8074 of the Eugene Code, 1971, <br />are added to provide as follows: <br />9.8070 Envision Eugene Comprehensive Plan Amendment - Purpose. The Envision <br />Eugene Comprehensive Plan is intended to reflect the community's long-term <br />vision. The Envision Eugene Comprehensive Plan must be flexible to adapt to <br />changing conditions and emerging needs in the community and to respond to <br />new data that relates to assumptions and projections in the plan.
