Attachment C
Dan,
Here is my understanding' could you please confirm or correct by Monday or Tuesday.
Jurisdiction
Based on the attached map from the City, the eastern section that's within the shaded area ("Ward
7") is in the City. The rest is in the County. Once I found this map, it seemed pretty clear.–There
was no map attached, but I would agree with this statement.
Classification
The County classifies Oakleigh Lane as a Local Access Road (LAR)– Yes Oakleigh Lane is classified as
a Local Access Road.
Applicable Standards
LC 15.706(2)(c) provides for applying Eugene street standards, but that's not under consideration
here.- I would however, point out that pursuant to Lane Code 15.706(2)(a), regarding
applicability, LC 15.706 standards apply to roads when located within Lane County’s land use
jurisdiction. By intergovernmental agreement, land use jurisdiction resides with the City of Eugene
inside of the city’s urban growth boundary. Since this development is located within the city’s
land use jurisdiction, Lane Code 15.706 does not apply, and thus LC 15.705 does not apply.
In this case it is up to the city to apply applicable standards. Even though the Local Access Road is
technically in Lane County, it is within the City of Eugene’s UGB and land use jurisdiction.
Please verify below for a road with same specs as Oakleigh Lane, if all within County
jurisdiction:
The proposed new PUD development comprises 29 condos is at the terminus of Oakleigh
Lane. There is no dispute that the projected ADT will be 168 (29 x 5.81), which is substantially
over the 101 ADT threshold in LC 15.706(2)(d).
LŷğǝĻƓƚƷƭƦĻĭźŅźĭğƌƌǤƩĻǝźĻǞĻķƷŷĻt
5ķĻǝĻƌƚƦƒĻƓƷ
ğƓǤƷźƒĻƩĻĭĻƓƷƌǤͲğƓķLŷğǝĻƓƚƷƭƦĻĭźŅźĭğƌƌǤƩĻǝźĻǞĻķƷŷĻLƓƭƷźƷǒƷĻƚҁƩğƓƭƦƚƩƷğƷźƚƓ9ƓŭźƓĻĻƩƭΛL9ΜͲƩźƦ
3
