Notice of the Planning Commission public hearing was mailed to the applicant, owners and <br />occupants of property within 300 feet of the subject property, and the Santa Clara Community <br />Organization on March 10, 2017. On March 22, 2017, notice of the Planning Commission public <br />hearing was also published in the Register-Guard, in accordance with the Eugene Code. <br />No written testimony has been received up to this point, and any testimony received after the <br />issuance of this report will be provided to the Planning Commission for consideration in making a <br />decision. Public testimony, written or otherwise, may also be presented at the public hearing <br />before the Planning Commission. <br />Applicable Criteria <br />The Planning Commission must address the relevant approval criteria at EC 9.8424 (listed <br />below) in making a recommendation to the City Council. The findings addressing these approval <br />criteria prepared by staff are attached for the Planning Commission's consideration (see <br />Attachment B). <br />9.8424 Refinement Plan Amendment Approval Criteria. <br />1) The refinement plan amendment is consistent with all of the following: <br />a) Statewide planning goals. <br />b) Applicable provisions of the Metro Plan. <br />c) Remaining portions of the refinement plan. <br />2) The refinement plan amendment addresses one or more of the following: <br />a) An error in the publication of the refinement plan. <br />b) New inventory material which relates to a statewide planning goal. <br />c) New or amended community policies. <br />d) New or amended provisions in a federal law or regulation, state statute, state <br />regulation, statewide planning goal, or state agency land use plan. <br />e) A change of circumstances in a substantial manner that was not anticipated at <br />the time the refinement plan was adopted. <br />STAFF EVALUATION <br />The basis for this request is to facilitate the construction of a new LTD bus station in the <br />southeastern portion of the subject site. The applicant's written narrative addresses the <br />approval criteria noted above to support the proposed policy text amendment. The attached <br />findings conclude that this request meets the applicable approval criteria, including consistency <br />with Statewide Planning Goals, the Metro Plan, and the remaining portions of the refinement <br />plan, and also that the refinement plan amendment addresses a change in circumstances in a <br />substantial manner not anticipated. <br />RECOMMENDATION <br />Staff recommends that the Planning Commission hold a public hearing and review the public <br />testimony related to the proposed refinement plan text amendment.
