Yet, Berg- <br />Johansen conspicuously withheld that critical fact from the Planning Commission because Berg- <br />Johansen understood it would be damning to the PUD application meeting the relevant <br />approval criterion in EC 9.8320(6). <br />Berg-Johansen repeated his deceptive tactics by also recruiting Mark Dahl, Deputy Fire <br />Marshal, to provide testimony; and, when Dahl failed to deliver exactly what Berg-Johansen <br />wanted, Berg-Johansen rewrote Dahl's conclusion to better serve his purpose of negating <br />opponents' evidence. <br />Exhibit E contains an e-mail string that appears to be in response to a prior request from <br />Berg-Johansen to Dahl. Berg-Johansen sends Dahl a message at 9:57 a.m. on April 12, 2017 - the <br />final day for testimony during the first evidentiary period: <br />"I put this on you last minute so I'm not expecting you to drop everything else!" <br />Berg-Johansen and Dahl then arrange to meet sometime after 10:00 a.m.; and subsequently Dahl <br />submits comments dated April 12, 2017 (Exhibit F), followed by Berg-Johansen submitting his <br />memo (Exhibit D). <br />After Berg-Johansen received Dahl's comments, Berg-Johansen compounded his <br />subterfuge by submitting to the Planning Commission false information about Dahl's <br />conclusions.
