15.706 Lane Code 15.706 <br />(iii) Submit objective evidence demonstrating that road grades in <br />excess of 8% are adequate for fire fighting equipment of the agency providing fire <br />protection to access the use and water supply. (Revised by Ordinance 1-75, Effective 3.15.74, 10- <br />04,6.4.04) <br />15.706 Public Road, Local Access Road, and Private Access Easement (Private <br />Road) Standards. <br />(1) General. <br />(a) Diagrams 13 and 14 in LC 15.710 illustrate Local Access Road and <br />private access easement design configurations. <br />(b) Pursuant to Oregon Revised Statutes (ORS) 368.031, the County <br />may spend money on Local Access Road improvements only under limited <br />circumstances, and only by order or resolution by the Board. <br />(2) Applicability. <br />(a) Subject to LC 15.706(2)(c), the standards in this section apply to the <br />following roads as defined in LC 15.010(35) when located within Lane County's land use <br />jurisdiction: <br />(1) Local Access Roads and Public Roads; <br />(ii) Private Access Easements (Private Roads). <br />(b) The standards in this section shall apply to Public Roads and Local <br />Access Roads consistent with the requirements of LC 15.045, and to Private Access <br />Easements consistent with LC 15.055. <br />(c) If requested by a city pursuant to an intergovernmental agreement, <br />the County may apply a city's standards to the roads listed in LC 15.706(2)(a) when such <br />roads are within a city's urban growth boundary. <br />(d) Roads listed in LC 15.706(2)(a) serving new development that will <br />generate average daily traffic (ADT) of more than 100 shall meet the requirements <br />specified in LC 15.705 for Rural Local Roads. 168 ADT for 29 condos <br />(e) Driveways that only serve one parcel and are entirely located on the <br />parcel served shall not be defined as easements and are exempt from the road design <br />standards. Notwithstanding this provision, driveway approaches shall meet the <br />applicable requirements of this chapter. <br />(f) The standards in this section apply for: <br />(i) Newly constructed roads; <br />(ii) Existing roads that are being reconstructed to Local Access <br />Road and Private Access Easement standards. <br />(g) Public Roads as defined in ORS 368.001(5) that have not been <br />accepted by the Board shall comply with the standards in this section. <br />(3) Right-of Way and Easement Width. <br />(a) The minimum right-of-way and private access easement width shall <br />be as specified in the following table: <br />Table 10: Minimum Right-of-Way and <br />Private Access Easement Width <br />1-3 Parcels <br />4 or More Parcels <br />Right-of-Way/ <br />Easement Width <br />30' <br />40' <br />(b) In addition to meeting minimum width requirements specified in LC <br />15.706(3)(a) above, the right-of-way and easement shall include adequate land for the <br />proposed travel area, rock slopes, utilities, drainage facilities, and any signs. <br />15-51 Lc15 <br />
