15.040 Lane Code 15.045 <br />(4) Criteria. An addition or change to a County Road functional classification <br />may be approved if. <br />(a) The addition or change will result in the County Road being used <br />consistent with the functional classification definitions found in LC 15.010(18). <br />(b) The addition or change will not result in an inconsistency with the <br />adopted General Plan Policies, including the policies of the Transportation System Plan. <br />(Revised by Ordinance No. 6-75, Effective 3.26.75; 4-80, 7.11.80; 10-04, 6.4- 04) <br />15.040 Action by Board. <br />(1) Within 30 days of a Planning Commission recommendation, the Board <br />shall schedule a public hearing. Such hearing and action by the Board shall be in <br />accordance with the provisions of this subsection for Planning Commission hearings and <br />the Lane County Charter. <br />(2) Prior to the hearing, the Planning Director shall forward to the Board a <br />copy of the record for the proposed addition or change, including all pertinent data filed <br />with the Commission and the minutes of the Planning Commission's public hearing. If a <br />recommendation on the matter was made by the Roads Advisory Committee, the minutes <br />of the Committee's discussion and recommendation shall be included in the materials <br />forwarded to the Board. <br />(3) At the hearing, the Board shall determine whether the proposed addition or <br />change is consistent with the criteria in LC 15.035(4) above. <br />(4) The Board shall not be required to follow the recommendation of the <br />Planning Commission or Roads Advisory Committee. (Revised by Ordinance No. 6-75, Effective <br />3.26.75; 4-80, 7.11.80; 10-04, 6.4.04) <br />MINIMUM ROAD REQUIREMENTS <br />15.045 Minimum Requirements for Public Roads and Local Access Roads. <br />The following minimum requirements shall apply to Public Roads and Local Access <br />Roads as defined in LC 15.010(35) when new development is proposed to ensure that <br />such roads will reasonably conform with the stated purpose of this chapter. Public Roads <br />as defined in ORS 368.001(5) that have been dedicated to the County but never accepted <br />by the Board shall also meet the requirements in this section. <br />(1) A Public Road or Local Access Road that is part of or serves a land <br />division shall comply with the following: <br />(a) the land division requirements in LC 13.050; and <br />(b) road dedication and improvement requirements in LC 15.105; and <br />(c) the provisions in LC 15.045(3) through (7) below. <br />(2) When a Public Road or Local Access Road is used to provide access to a <br />vacant lot or parcel where development other than a land division is proposed, prior to <br />land use and zoning authorization for the proposed development the following shall <br />apply: <br />(a) The applicant for the proposed development shall provide written <br />certification from the applicable Fire District, on a form prepared by Lane County, that <br />the Public Road or Local Access Road meets minimum Fire District requirements to <br />provide emergency services to the property. <br />(b) If the applicant is unable to obtain the written certification specified <br />in LC 15.045(2)(a), the property owner shall record a Covenant and Hold Harmless <br />Declaration to run with the land and in a form acceptable to Lane County that includes <br />the following information and provisions: <br />15-8 Lci5 <br />
