OAKLEIGH <br />111{,X11)GW <br />• <br />BY THE CITY, SHALL BE APPROVED BY CITY STAFF, AND BE SUBJECT TO A REVIEW AND <br />PAYMENT OF FEE SET BY THE CITY MANAGER. <br />EC 9.2750(10) EXCEPT AS PROVIDED IN THIS SUBSECTION (10), NO INTERIOR SETBACK <br />ALONG THE SIDE PROPERTY LINES IS REQUIRED IF THE BUILDINGS ABUT OR SHARE A <br />COMMON WALL THAT CONFORMS TO ADOPTED STATE BUILDING CODES. A 5 FOOT <br />SETBACK IS REQUIRED AT THE END OF THE ROWHOUSE BUILDING, OR A MINIMUM OF 10 <br />FEET BETWEEN THE ROWHOUSE BUILDING AND ANY ADJACENT BUILDING. A 5 FOOT <br />SETBACK IS ALSO REQUIRED ALONG AN ALLEY. <br />Findings: Oakleigh Meadow LLC, the applicant, has reached-out to the <br />owners, Jim and Sharon Brandt, of the neighboring property directly to <br />the West of the development property. The applicant and the <br />neighboring owners are working towards a .Maintenance Easement <br />Agreement to serve the proposed site fence and to ensure the proposed <br />fence and its maintenance complies with Eugene Code and relative <br />building codes. <br />• <br />The PUD proposes garages and carports along the West property line <br />because it makes for a safer site layout and better resource management, <br />reducing encroachment into the floodplain and existing natural open <br />space. If a five or seven foot setback along the interior property line <br />were required, the project would encroach the sewer easement on the <br />East property line, increase the amount of required earthen fill by <br />thousands of yards, and reduce the number of dwellings. Such a change <br />would be devastating to the financial viability of the project. <br />In order to provide a solution that allows for emergency vehicle access, <br />noise and headlight reduction, and development benefits to both <br />properties, the applicant requests a reduction to the minimum interior <br />yard setback for the West property line from 5 feet to zero feet, allowing <br />for the construction of common wall garages and carports and common <br />wall detached auxiliary structures between adjoining parcels as permitted <br />by applicable building codes. Please see proposed site plans and <br />elevations for further information. <br />The proposed noncompliance is consistent with the purposes of a <br />planned unit development as set forth in EC 9.8300 and will create a <br />sustainable environment for a variety of dwelling types that preserves <br />existing natural resources and allows for the clustering of residential <br />dwellings to achieve energy and resource conservation. <br />• <br />PUD Tentative -June 14, 2013 Page 42 of 46 Oakleigh Cohousing PDT 13-0001 1401 <br />
