The purpose of this agreement is to adjust the common property line between the adjoining <br />_`..i tracts of land. <br />--.I B, Tract 1 (David Zarzyckl property) is described in a Warranty Deed recorded May 7, 1982, <br />Reel 1191R, Instrument No. 8213424`Ofcial Records of Lane County, Oregon and Tract 2 (Joseph Minor <br />and Carol Pound property) is described In a Warranty Deed recorded June 23, 1983, Reel 1250R, <br />Instnament No. 8321351, Official Records of Lane County, Oregon. <br />C. In adjusting the property line common to both tracts of land, it Is intended that a portion of Tract <br />1 (David Zarzyckl property), as described In Exhibit A, be conveyed and added to Tract 2 (Joseph Minor <br />and Carol Pound property), described in Exhibit B. It is also intended that the new description for Tract 2 <br />(as found in Exhibit D) contain this portion of property. <br />Agreements: A_ For the purpose of accomplishing this Property Line Adjustment, both parties have agreed <br />as follows: <br />i=f• i 1. The foregoing recitals are by this reference Incorporated herein. <br />2. To effectuate the relocation of the common property line, it is agreed that the tract of property <br />described In Exhibit C contains the new description for Tract I (David Zarzycki property) and the tract of <br />property described In Exhibit O contains the new.description for Tract 2 (Joseph Minor and Carol Pound <br />cam;;' i property). David Zarzycki, does hereby grant and convey to Joseph Minor and Carol Pound such <br />portions of his property that results In Joseph Minor and Carol Pound owning in fee the newly described <br />Tract 2, <br />3. This Instrument is being recorded to establish a new property line by the owners In fee and the <br />consideration for this conveyance is $ 0.00. <br />4. Theadjusted portion of the Zarzycki property to be added to the Minor and Pound property Is <br />'i underlined in the attached Exhibits C and D. <br />5, In event that any deed, Instrument, or other act is necessary to complete the intent of the <br />parties as described in this document, each party hereby irrevocably appoints and designates the other(s), <br />or the sucessors in interest, as their altomey(s) in fact, to convey, execute, or transfer any deed or other <br />document necessary or helpful to filfuli this agreement and the Intent of the parties, . <br />This instrument will not allow use of the property described In this Instrument in violation of applicable land <br />use laws and regulations. Before signing or accepting this Instrument, the person or persons acquiring fee <br />title to the property should check with the appropriate city or county planning department to verify approved <br />uses and to determine any limits on lawsuits against farming or forest practices as defined In ORS 30.930. <br />- 467 <br />
