However, the <br />EPC limited who could submit testimony to the applicant, Simon Trautman, and their respective <br />representatives. <br />ORS 197.763(7) requires: <br />When a local governing body, planning commission, hearings body or hearings officer reopens a <br />record to admit new evidence, arguments or testimony, any person may raise new issues which <br />relate to the 'new evidence, arguments, testimony or criteria for decision-making which apply to <br />the matter at issue. (Emphasis added.) <br />Allowing the applicant and Mr. Trautman to submit additional evidence and argument without also <br />allowing me and other participants in this matter to submit testimony would be unfair and prejudice my <br />substantial rights. <br />As a precautionary measure, I am objecting to the EPC rejecting my forthcoming testimony, including new <br />evidence submitted by August 31, 2015 and arguments submitted by the deadline set by the EPC. <br />Respectfully submitted, . <br />C(` evv_~ <br />Paul Conte <br />239 : <br />0 <br />• <br />
