At that time, and on advice of staff, the Planning Commission determined that <br />the record would be held open for new evidence, for response to that evidence and for <br />final written argument. The Commission decided to rely on the standard "7-7-7" <br />open-record sequence under ORS 197.763, but extended the initial open-record period <br />.for approximately two weeks to August 31, 2015, then allowed parties to respond to <br />the new evidence until September 4, 2015 and provided for the applicant's final <br />written argument on September 11, 2015. <br />On Friday, August 21, 2015, City Attorney Anne Davies confirmed this timeline <br />with a summary provided to attorney Kabeiseman stating: <br />"The record is open initially until close of business on August 3111 for new <br />evidence on that issue; evidence in response to those submittals are due by <br />close of business on September 4`s; final rebuttal by applicant is due by <br />September 11." <br />Oakleigh Meadow Co-Housing conformed to the Planning Commission's <br />timeline, providing materials in advance of the August 31St deadline, materials <br />responsive to the opponents' evidence and argument before the close of business on <br />September 4, 2015, and provided a final written argument on September 11th. <br />400 WOOLWORTH BLDG • 940 Willamette Street • MAIL: Po Box 10886 • Eugene, Oregon 97440 • PHONE: 541 686-9160 • FAX: 541343-8693 <br />wwmeugenelaw.com <br />343 <br />463 <br />
