Eugene Planning Commission <br />September 11, 2015 <br />Page 8 <br />was required-to adopt conditions of approval in this PUD decision that requires the <br />purchase or condemnation of property that OMC does not own to provide this 45-foot <br />right-of-way, and paving of additional portions of the right-of-way. Id: at 13,_25. The <br />City Code does not require that all existing streets meet current-City standards, or that <br />Oakleigh Lane be expanded along its entire length. <br />EC 9.6870 provides the yardstick for new streets and dedication areas. The City <br />used the yardstick in Table 9.6870 to determine the appropriate width of the <br />dedication area for the half-street right-of-way south of the centerline. It did not, <br />however, and was not required to immediately require. that the entire length of <br />Oakleigh Lane be immediately upgrade to meet current City standards. As the <br />Planning Commission found, these standards do not apply to "existing streets" - like <br />Oakleigh Lane - until such time as they are brought up to City standards. This is only <br />reasonable in view of the fact that most of Oakleigh Lane was dedicated by plat in <br />1927, well before the current City standards existed. <br />The PUD meets the current street standards under EC 9.6870. Its dedication <br />area will provide half of the future 45-foot right-of-way south of the centerline of <br />Oakleigh Lane when the street is developed to City standards. In addition, by <br />executing the Irrevocable Petition for Public Improvements required by Condition of <br />Approval 7; OMC has obligated itself to pay its "proportionate share of the street <br />construction costs" when a majority of the benefitted property owner agree to the <br />• improvement of the street. See September 17, 2013 Memorandum from Ed Haney to Becky <br />Taylor, p. 15. LUBA Rec. 1269. This is the kind. of proportional dedication and <br />improvement that EC 9.8320(5)(a) and EC 9.6870 requires for new development, and <br />OMC has clearly met its obligations under the Code. <br />3. OMC Provides a Safe and Adequate Transportation System In Accordance <br />with the City's Code. <br />EC 9.8320(5) looks to three factors to demonstrate that a Planned Unit <br />Development. will provide "safe and adequate transportation systems." It states: <br />"The PUD provides safe and adequate transportation systems through <br />compliance with the following: <br />(a) EC 9.6800 through EC 9.6875 Standards for Streets, Alleys, and Other Public <br />Ways (not subject to modifications set forth in subsection (11) below).. <br />(b) Pedestrian, bicycle and transit circulation, including related facilities, as <br />needed among buildings and related uses on the development site, as well <br />as adjacent and nearby residential areas, transit stops, neighborhood activity <br />centers, office parks, and. industrial parks, provided the city makes findings <br />to demonstrate consistency with constitutional requirements. "Nearby" <br />means uses within 1/4 mile that can reasonably be expected to be used by <br />pedestrians, and uses within 2 miles, that can reasonably be expected to be <br />used by bicyclists. <br />F-] <br />311 <br />431 <br />
