Future Street Improvements <br />4 Conte argues that the city misconstrued EC 9.8320(11) (b) and <br />5. 9.6505(3)(b) in failing to require the portion of Oakleigh Lane located on the <br />6 subject property to be improved (paved with curbs, gutters and sidewalks, <br />,7 installed) to.the.paving width standards in EC 9.6870 upon construction of the <br />8 PUD, and instead requiring Meadows to sign an irrevocable petition for public <br />9 . improvements and assessment for the improvements if and when the city <br />10 initiates a local improvement process.12 Conte Petition for Review 35-37. <br />12 EC 9.6505 provides in relevant part: <br />"Improvements - Specifications. All public improvements shall be <br />,designed and constructed in accordance with adopted plans and <br />policies, the procedures specified in Chapter 7 of this code, and <br />standards and specifications adopted pursuant to Chapter 7 of this <br />code. Additionally, all developments shall make and be served by <br />the following infrastructure improvements: <br />"(3) Streets. and Alleys. <br />CC* * * * * <br />"(b) The developer shall pave streets and alleys adjacent to <br />the development site to the width specified in EC <br />9.6870 Street Width, unless such streets and alleys are <br />already paved to that width, provided the City makes <br />findings to demonstrate consistency with <br />constitutional requirements.
