precludes further appeal based on that issue. The basis of the appeal is limited to the issues raised <br />during review of the original application and otherwise set out in the appeal statement. New <br />evidence pertaining to the appeal issues will be accepted. <br />Additional Information and Staff Report: <br />The Planning Director's decision approving this application, the appeal and all previously <br />submitted testimony and materials, including all documents and evidence submitted by or on <br />behalf of the applicant, and the applicable approval criteria for Traffic Impact Analysis Review at <br />Section 9.8680 of the Eugene Code, are available for free inspection at the City of Eugene Planning <br />Division, 99 West 101h Avenue, Eugene, Oregon 97401 between 9:00 a.m. and 5:00 p.m. Copies <br />may also be obtained at a reasonable cost. <br />These materials are also available on the City's land use application website at: <br />http://pdd.eugene-or.gov/LandUseZSearcliApplicatiotiDocurnents?file=TIA-16-0007. The staff <br />report to the Hearings Official on this appeal will also be made available for inspection at no cost <br />at least 7 days in advance of the public hearing. The staff report may be obtained at the same <br />location(s) noted above for free inspection. Hard copies may also be obtained at a reasonable cost. <br />Conduct of Public Hearing: <br />The public hearing will follow quasi-judicial procedures at EC 9.7625, and EC 9.7065-9.7095. The <br />order of procedure will be as follows, unless modified by the Hearings Official as may be necessary <br />or appropriate: <br />1. The Hearings Official will summarize procedures and commence the hearing. <br />2. City staff will provide a brief introduction and summary of the application/appeal. <br />3. Testimony will first be allowed frorn proponent/applicant. <br />4. Comments or questions will then be allowed from interested people who are neither <br />proponents nor opponents (neutral parties). <br />5. Testimony will then be allowed from opponents. <br />6. Staff may provide a response to testimony, as needed. <br />7. The Hearings Official may then ask questions of staff (note that the Hearings Official may also <br />raise questions that might arise during any individual testimony). <br />8. Rebuttal will then be allowed from the proponent/applicant. <br />9. Finally, the Hearings Official will announce whether the hearing and record is closed, held <br />open, or if the public hearing will be continued. <br />The Hearings Official will render a decision on the appeal based on whether or not the Planning <br />Director properly evaluated the request and made a decision consistent with applicable criteria at <br />EC 9.8680. Since this is the first public hearing held on the matter, new evidence and information <br />may be submitted. The Hearings Official will review the application, the Planning Director's <br />decision, the appeal, and any additional evidence and comments submitted. Please note that the <br />Hearings Official will not be making a decision the same night of the hearing. The Hearings Official <br />will issue a decision within 15 days from when the public record on the application closes. The <br />Hearings Official may affirm, reverse, or modify the decision of the Planning Director.
