December 3-4, 2015 - LCDC Salem <br />Agenda Item 4, Attachment H <br />1 remain planned and zoned for that use unless the local government removes the land from the <br />2 UGB. <br />3 OAR 660-024-0067 <br />4 Evaluation of Land in the Study Area for Inclusion in the UGB; Priorities <br />5 (1) When considering a UGB amendment, a local government outside of Metro must decide <br />6 which land to add to the UGB by evaluating all land in the study area determined under OAR <br />7 660-024-0065, as follows: <br />8 (a) Beginning with the highest priority category of land described in section (2) of this rule, <br />9 the local government must apply section (5) to determine which land in that priority category <br />10 is suitable to satisfy the need deficiency determined under OAR 660-024-0050 and select as <br />11 much of the land as necessary to satisfy the need. <br />12 (b) If the amount of suitable land in the first priority category in section (2) is not sufficient to <br />13 satisfy all the identified need deficiency, the local government must apply section (5) to <br />14 determine which land in the next priority is suitable and must select as much of the suitable <br />15 land in that priority as necessary to satisfy the need. The local government must proceed in <br />16 this manner until all the land need is satisfied. <br />17 (c) If the amount of suitable land in a particular priority category in section (2) exceeds <br />18 the amount necessary to satisfy the need deficiency, the local government must choose <br />19 which land in that priority to include in the UGB by applying the criteria in section (6) of <br />20 this rule. <br />21 (2) Priority of Land for inclusion in a UGB: <br />22 (a) First Priority - Urban reserve, exception land, and nonresource land. Lands in the study <br />23 area that meet the description in paragraphs (A) through (C) of this subsection are of equal <br />24 (first) priority: <br />25 (A) Land designated as an urban reserve under OAR chapter 660, division 21, in an <br />26 acknowledged comprehensive plan; <br />27 (B) Land that is subject to an acknowledged exception under ORS 197.732; and <br />28 (C) Land that is nonresource land. <br />29 (b) Second Priority - Marginal Land: land within the study area that is designated as <br />30 marginal land under ORS 197.247 (1991 Edition) in the acknowledged comprehensive plan. <br />31 (c) Third Priority - Farm or forest land that is not predominantly high value farm land: land <br />32 within the study area that is designated for agriculture or forest uses in the acknowledged <br />33 comprehensive plan and that is not predominantly high-value farmland as defined in ORS <br />34 195.300, or that does not consist predominantly of prime or unique soils as determined by the <br />35 United States Department of Agriculture Natural Resources Conservation Service.
