December 3-4, 2015 - LCDC Salem <br />Agenda Item 4, Attachment A <br />Proposed New Rules to Implement ORS 197A Public Draft 3 - November 23, 2015 <br />1 population of the city has grown by 100 percent of the population growth forecast to occur in <br />2 conjunction with the city's previous use of this division. <br />3 (6) A city that adopts a UGB amendment using this division may subsequently add land to the <br />4 UGB using division 24 instead of the method described in this division (see options, below) <br />5 OPTION 1: (limited authority to use traditional method after use of simplified method) <br />6 provided the purpose for expansion of the UGB is: <br />7 (a) To accommodate a particular industry use that requires specific site characteristics, or to <br />8 accommodate a public facility that requires specific site characteristics and the site <br />9 characteristics may be found in only a small number of locations as provided in OAR 660- <br />10 024-0065(3),- <br />11 (b) To designate Regional Large Lot Industrial Land pursuant to OAR 660-024-0045; <br />12 (c) To add an amount of land less than necessary to satisfy the land need deficiency under <br />13 OAR 660-024-0065(9); or <br />14 (d) After one or more of the circumstances in section (4) have occurred. <br />15 OPTION 2: (broad authority to use traditional method after use o f simplified method) <br />16 provided, however, that a city's determination of land need resulting from the previous use of <br />17 this method shall not by itself he considered sufficient to support a housing and employment need <br />18 determination under OAR chapter 660, division 24. <br />19 (7) A city may not use this division in order to evaluate or amend a UGB for purposes of OAR <br />20 660-024-0045 concerning Regional Large Lot Industrial Land. <br />21 (8) A city that elects to use this division shall notify the department in the manner required by <br />22 ORS 197.610, ORS 197.615 and OAR chapter 660, division 18 regarding notice of a post- <br />23 acknowledgment plan amendment. The city may revoke its election under this section at any <br />24 time until the city makes a final decision to amend the UGB. <br />25 (9) A city that initiated an amendment of its UGB under OAR chapter 660, division 24, but has <br />26 not submitted that amendment to the department, may withdraw the proposed amendment and <br />27 use a method described in this division by filing notice of the election with the department in the <br />28 manner required by ORS 197.610, 197.615, and OAR chapter 660, division 18 for notice of a <br />29 post-acknowledgment plan amendment. <br />30 (10) Notwithstanding ORS 197.626, when a city evaluates or amends the UGB pursuant to this <br />31 division, the Land Use Board of Appeals rather than the commission has jurisdiction for review <br />11/23/2015 3:43:00 PM <br />http://intranet.dlcd.state.or.us/projects/UGBRAC/Reference Documents/660-038_3rdPublicDraft_2015-11-20.docx v2.0 <br />4 <br />
