Since the property to the west of the subject property is owned by the City of Eugene, the applicant <br />may place key urban facilities within this right-of-way in accordance with City Standards, something that the applicant <br />has shown as a feasible option. The City owned right of way provides a continuous corridor for utilities, transportation, <br />Fire and existing recreational activity consistent with the Annexation approval criteria in EC 9.7825 (3). Although the <br />applicant's preferred method would be to have a utility easement through Mr. and Mrs. Holleran's property, they have <br />the right to deny the applicant's request. Lack of an easement across Mr. Holleran's property is not problematic and <br />does not preclude the annexation or development of the Furtick property. All key urban services can be provided to the <br />subject property in an orderly, efficient and timely manner within the City owned right of way consistent with EC <br />9.7825(3). The City of Eugene's Public Improvement Design Standards Manual requires that all wastewater mains be <br />within public right-of-way or easements and that they maintain minimum slopes. The City of Eugene allows for private <br />wastewater laterals to be pumped to the main line if grade is an issue. <br />Hope this helps.
