They include revisions and additions that incorporate portions of the City's proposed <br />conditions of approval submitted as part of and as an attachment to the City's July 8, 2016 <br />Memorandum to the Hearings Official ("City Memorandum"). Each suggested condition is <br />followed by a comment explaining the reasoning behind the Applicant's suggested condition, <br />revisions made to the suggested condition, and why it is preferable, in whole or in part, to the <br />City's corresponding condition. <br />General Conditions <br />COA 1. The land use approval runs with the land and may be developed by the <br />Applicant and/or Applicant's successors or assigns. <br />Comments: As noted in the City Memorandum, this condition does not directly relate to an <br />approval criterion. However, given the nature of how CIR housing is developed through <br />affordable housing organizations that must develop housing projects and seek funding sources <br />for a CIR proposal, it is prudent to include this condition of approval. Combined with similar <br />language in the performance agreement, which the City Memorandum indicates is its typical <br />practice, reviewers and funders of CIR project proposals will have the necessary assurances that <br />land use authorization to develop CIR housing on the site will transfer with the land. <br />COA 2. As allowed by EC 9.718, the CIR CUP shall terminate unless an application <br />for a development permit needed to implement the CIR CUP is applied for <br />within 7 years of the effective date of approval.
