LUBA establishes the <br />credibility of LHVC Sheet 9/2/15-04 which clearly shows the location of the Parks and <br />Open Space acreage on the Environ-Metal land. This configuration was achieved as <br />demonstrated in two presentations on record: <br />1. In Public Testimony - Opponents Post-Hearing of 9/2/15 Gunnar Schlieder shows <br />how to develop maps that establish the POS boundary on the Environ-Metal parcel <br />including the oft referred to Sheet 9/2/15-04. The argument that he didn't use the <br />appropriate Metro Plan has been negated and put to rest. This is addressed in <br />"Testimony Rec'd at Planning Commission Appeal PH 10-20-2015 Exhibit #6" and <br />reiterated in the LUBA document. <br />2. The use of the Eugene City Limit line was addressed in "Testimony Rec'd at Planning <br />Commission Appeal PH 10-20-2015 Exhibit #4". This is part of the argument to appeal <br />to more than one referent and to allow the use of other site specific maps. <br />LHVC concludes that the HO should rule that sheet 9/2/15-04 is the determinant for the <br />POS boundary on the applicant's property which sets aside approximately 40 acres for <br />that purpose. <br />It seems appropriate to question the designation of the northern section of this property <br />since many issues regarding the zone change were brought up. Several submissions of <br />record were made such as (01 Public Record Pages 1-204 Misc. 10/23/2015 pp. 74-78). <br />It doesn't seem reasonable to designate a zone when the acreage and demarcation of a <br />property are unknown. The northwestern portion contains extensive so-called riparian <br />corridors and is the headwaters of Laurel Hill Creek which can be seen in the Eugene <br />Stormwater Master Plan, Volume IV. The City of Eugene has gone on record as <br />wanting to protect such areas from development. Considerable time and money has <br />been spent on surveying for upland wildlife habitat and riparian corridors. These <br />designations should be honored and these sensitive environments preserved. <br />
