AM <br />WPIanning <br />Memorandum <br />Date: September 14, 2016 <br />To: Fred Wilson, Eugene Hearings Official <br />From: Erik Berg-Johansen, Assistant Planner, (541) 682-5437 <br />Subject: LUBA Remand: Laurel Ridge Zone Change (Z 15-5) <br />Background <br />The Laurel Ridge zone change application (Z 15-5) was originally submitted on May 27, 2015 by <br />Environ-Metal Properties, LLC. The subject site is located west of Moon Mountain in Eugene's <br />Laurel Hill Valley neighborhood. More specifically, Tax Lot 701 (approximately 98 acres) is the <br />northern-most of the two parcels, and is located just south of the terminus of Riverview Street <br />and Hendricks Hill Drive. Tax Lot 703 (approximately 23 acres) is the adjacent parcel to the <br />south, located approximately 250 feet northeast of 30th Avenue. A vicinity map is also included <br />as Attachment A. <br />An initial public hearing to rezone the subject site to R-1 Low-Density Residential and POS Parks <br />and Open Space with /PD Planned Unit Development and /WR Water Resources Conservation <br />overlay zones was held on August 26, 2015, and the zone change was conditionally approved by <br />the Eugene Hearings Official on September 24, 2015. On October 6, 2015, Weltzin (Bill) Blix filed <br />an appeal on behalf of the Laurel Hill Valley Citizens (LHVC) neighborhood group. The appeal <br />was focused on the location of the boundary line between the proposed Low-Density Residential <br />zoning and Park, Recreation and Open Space zoning. The zoning is required to be consistent with <br />the Metro Plan diagram's plan designations for Low Density Residential (LDR) and Parks and <br />Open Space (POS). On October 20, 2015, the Eugene Planning Commission held a public hearing <br />on the appeal, and concluded their deliberations on October 26, 2015. The Planning Commission <br />agreed with the Hearings Official's decision and affirmed the zone change approval on October <br />29, 2015. <br />Both the applicant and the neighborhood group appealed the Planning Commission's decision to <br />the Oregon Land Use Board of Appeals (LUBA). In that appeal, LUBA decided to send the case <br />back (or "remand") to the City to allow the Hearings Official to reevaluate the proposed zone <br />change.
