Exhibit 9 <br />9.6710 Geological and Geotechnical Analysis. <br />(2) Geological and Geotechnical Analysis Required. Except for those activities exempted <br />under EC 9.6710(3) Exemptions from Geological and Geotechnical Requirements, a <br />geological and geotechnical analysis, prepared by an Oregon licensed Engineering <br />Geologist or an Oregon licensed Civil Engineer with geotechnical experience, conforming <br />with standards, procedures and content as defined in the Standards for Geological and <br />Geotechnical Anlaysis adopted by the city in the manner set forth in EC 2.019 City <br />Manager - Administrative and Rulemaking Authority and Procedures, is required for any of <br />the following: <br />(b) All proposed development that includes dedication or construction of a public street <br />or alley or the construction of public drainage systems or public wastewater sewers. <br />The subject proposal does not include dedication or construction ofpublic transportation <br />facilities or utilities. Hence, a Geotechnical Analysis is not necessary per the criterion cited <br />above. <br />9.6885 Tree Preservation and Removal Standards. <br />(1) Exemptions from Standards. The standards in this section do not apply to activities <br />regulated under EC 9.4900 through 9.4980, or an application for Eugene Code <br />development activity that includes or will result in: <br />(b) Land Use Approvals. Any tree removal on property subject to an approved conditional <br />use permit, planned unit development, site review, or subdivision that include a tree <br />removal/preservation plan or conditions related to tree removal or retention. In those <br />areas, that plan or city approved modifications thereto control tree removal. This <br />exemption does not apply to the removal of a street tree, which must be authorized by <br />a permit issued pursuant to EC 6.305; <br />The subject request includes a Site Review application, as well as a Willamette Greenway <br />permit. Therefore, the standards in EC 9.6885 do not apply. Please see below for findings in <br />response to EC 9.8440(2). <br />9.8440 Site Review Approval Criteria-General. The planning director shall approve, <br />conditionally approve, or deny the site review application. Approval or conditional approval <br />shall be based on compliance with the following criteria: <br />(2) Proposed lots, buildings, streets, parking lots, recreation areas, and other proposed uses <br />are designed and sited to minimize impacts to the natural environment by addressing the <br />following: <br />(a) Protection of Natural Features. <br />1. For areas not included on the City's acknowledged Goal 5 inventory, the <br />preservation of significant natural features to the greatest degree attainable or <br />feasible, including: <br />a.
