Exhibit 2 <br />Eugene Code <br />the city is set aside, annulled, declared or rendered void, or its enforcement <br />is restrained by any court of competent jurisdiction, or when the council <br />doubts the validity of the assessment or reassessment or any part thereof, <br />the council may reassess in the manner provided by state law provided, <br />however, that the council or its designee may conduct any hearings as <br />provided in sections 7.166 and 7.187. <br />(Section 7.265 added by Ordinance No. 17955, enacted April 11, 1977; amended by Ordinance <br />No. 19393, enacted July 28, 1986, effective January 28, 1987.) <br />7.270 Citv Bonds in Pavment of Special Assessment Liens and Citv Property. <br />(1) The finance officer is authorized to accept general obligation bonds and <br />attached coupons of the city in payment of any part of special <br />assessment liens, interest and penalties payable to the city, and is <br />further authorized to accept the bonds and interest coupons in payment <br />of the purchase price of any lands for sale by the city. <br />(2) Nothing contained in subsection (1) shall authorize the finance officer to <br />pay out any funds or credit of the city for an excess of bonds or interest <br />coupons over the payment sought to be made as provided in the <br />preceding section. <br />(3) Bonds accepted under subsection (1) shall be reviewed by the finance <br />officer only after they have been approved as to maturities by the <br />council, it being the purpose of this subsection to limit the acceptance of <br />bonds to such maturities as are to the advantage of the city. <br />(Section 7.270 amended by Ordinance No. 17955, enacted April 11, 1977.) <br />7.280 Street Tree Program - Policy, Standards, Procedure. <br />(1) Policy. In order to create attractive and healthy neighborhood <br />environments, no approval shall be granted for a development that <br />involves the creation of a street unless the applicant has submitted and <br />received approval of a street tree plan that ensures street trees will be <br />planted and established in accordance with the standards and <br />procedures provided for in this section and the adopted policies of the <br />Urban Forest Management Plan. Street trees shall be planted in <br />accordance with the approved street tree plan as each lot or area is <br />developed, and shall be required on streets that abut the development <br />as well as on new streets within the development site. <br />(2) Standards. The city manager, or designee, shall by administrative rules <br />adopted pursuant to section 2.019 of this code establish standards and <br />specifications that ensure that new trees planted are of the highest <br />quality, require low maintenance, and do not interfere with public safety. <br />The standards shall include, but not be limited to, the type of trees that <br />may be planted, and requirements for planting and establishment of the <br />trees. As used in this section, "establishment" includes watering, initial <br />pruning, and replacement of trees, if necessary, for a period of three <br />years from the date of planting. <br />(3) Procedure.
