Suggested Conditions of Approval, COA 3, June 29, 2016, adopted by the Hearings Official <br />as Condition 2. <br />The applicant also requested and obtained the authority to determine, in the future, all <br />matters pertaining to development. COA 2 of the Hearings Official's Conditions of <br />Approval, which was requested by the applicant, states that "[t} he timing, size, mix of units, <br />the number, location and development to be included in each phase and all other matters <br />pertaining to development of the approved CIR CUP are to be determined by the <br />applicant". <br />The vagueness of the application and the authority granted to the applicant in the future <br />deprives the neighbors of a meaningful opportunity to challenge the development at the <br />hearing level, creating a procedural violation. <br />In light of the above, the Commission should hold that the Hearings Official erred in <br />granting the approval. <br />(These points were raised in my Post Hearing Submittal, pp2-3) <br />Respectfully submitted, <br />~/V•r <br />Marilyn Cohen and co-appellants <br />14 <br />
