APP-33 <br />The applicant additionally notes that there are two dispersion points-one to <br />the north, which sends traffic onto the portion of the Eugene street network <br />leading to the 30th Ave./Hilyard grid, and one to the south connecting the <br />portion of the Eugene street network comprised of Fox Hollow/Donald/ <br />Willamette Street. The applicant states that the two street networks are <br />sufficiently separated that if a blockage occurred on one, the other would <br />not be affected. The hearings official concurs. (See page 20 of HO Decision.) <br />This standard stems from Fire Code about isolated access. The concern would be if <br />West Amazon Drive dead-ended at the site. Instead, the Applicant proposes to <br />improve West Amazon Drive between the existing street improvements at the north <br />and south ends of the site. South of the site, West Amazon Drive has a paved driving <br />surface that eventually connects with Fox Hollow Road. Fire staff has confirmed that <br />this meets their requirements for providing two points of access. <br />The HO's finding of compliance is specific to the western portion of the site (the-'7 <br />-lot plan). With respect to the eastern portion of the site (as shown on the 75-lot <br />plan) the HO found that removal of the eastern portion of the proposed <br />development would seem to resolve the Fire Marshal's access concerns, but his <br />determination was not conclusive with respect to the approval criteria at EC <br />9.8325(6)(c). The PC finds that even if the eastern portion of the proposed <br />development were to remain, it would not cause a violation of the "19-lot rule" <br />because the traffic from Canyon Drive would connect with West Amazon Drive and <br />use the same two points of dispersion to the north and south. <br />The PC agrees with the HO's determination that the internal street design, <br />connected with the proposed improvements to West Amazon Drive, will serve to <br />disperse traffic onto more than one public local street as required. The PUD also <br />provides street stubs to the south and west for additional street connections. This <br />standard is really about dead-end streets, where there is only one way in or out. <br />With the applicant's improvement of West Amazon Drive, the site can be accessed <br />from the north via Martin Street or from the south via Fox Hollow Road. The issue <br />here would have been if West Amazon Drive did not connect to Fox Hollow Road. <br />The Applicant's improvements will complete the missing connecting link in the street <br />system. <br />PC Decision: The PC agrees that the HO did not err in finding compliance with the above approval <br />criterion at EC 9.8325(6)(c), but modifies the HO's decision to add a finding that even <br />if the eastern portion of the proposed development were to remain, it would not <br />cause a violation of the "19-lot rule" because the traffic from Canyon Drive would <br />connect with West Amazon Drive and use the same two points of dispersion to the <br />north and south. <br />V.
