Planning & Development <br />Planning <br />City of Eugene <br />99 West 101h Avenue <br />Eugene, Oregon 97401 <br />(541) 682-5377 <br />(541) 682-5572 FAX <br />www.ci.eugene.or.us <br />May 27, 2004 <br />Bill Kloos <br />Law Office of Bill Kloos, PC <br />PO Box 11906 <br />Eugene, Oregon 97440 <br />RE: Code Interpretation regarding EC 9.8325(3) <br />City Fite CI 04-4 <br />Summary of Request: <br />In accordance with Section 9.0040, Land Use Code and Decision Interpretation, you submitted a request <br />for a Planning Director interpretation concerning whether the Tentative Planned Unit Development <br />Approval Criteria - Needed Housing, EC 9.8325(3), allows for streets (as defined by the code) and fences <br />to be located within the required 30 foot wide landscape buffer area along the perimeter of a planned unit <br />development (PUD). <br />The criterion of EC 9.8325(3) is as.follows; <br />The PUB provides a buffer area between the proposed development and surrounding <br />properties by providing at least a 30 foot wide landscape area along the perimeter <br />of the PUD according to EC 9.6210(7) <br />Findings and Conclusion: <br />The criterion of EC 9.8325(3) requires a 30 foot wide landscape buffer between the proposed <br />development and surrounding properties. The required landscape buffer must comply with EC 9.6210(7), <br />Massed Landscape Standard (L-7). EC 9.8325(3) does not provide for any exceptions or deviations from <br />this requirement and EC 9.6210(7) does not allow streets or fences. As such, for a PUD proposed under <br />the City's needed housing track, no streets or fences are allowed within the 30 foot wide landscape area <br />that buffers the proposed development from surrounding properties. It should be noted, however, that <br />pursuant to EC 9.8325(3), the 30 foot wide landscape area is required to buffer the proposed development <br />from surrounding properties. The landscape area need not buffer the proposed development from <br />surrounding streets. <br />
