as a new tentative PUD application. <br />9.8375 Final Planned Unit Development - Landscaping. If required landscaping cannot be <br />completed prior to occupancy, or as otherwise required as a condition of approval, the <br />planning director may require the applicant to post a performance bond in an amount and <br />for a time period determined by the planning director to be sufficient to assure timely <br />completion. <br />Property Line Adjustment <br />9.8400 Purpose of Property Line Adjustment. Sections 9.8400 through 9.8420 provide an <br />expedited process for the review of property line adjustments. A property line <br />adjustment is the relocation of a single boundary line or the removal of non-platted lines <br />between two legal lots. Property line adjustments shall be considered in accordance with <br />the Type I application procedures contained in EC 9.7100 General Overview of Type I <br />Application Procedures. <br />9.8405 Applicability of Property Line Adjustment Applications. <br />(1) A property line adjustment application is applicable to changes to the property <br />lines of adjoining properties when all of the following exist: <br />(a) A property line proposed for removal is not platted in a partition or <br />subdivision plat. <br />(b) A property line proposed for adjustment will not result in an increase in the <br />number of parcels or lots. <br />(c) A property line proposed for adjustment will not create more than 2 property <br />line adjustments to any of the boundaries of an individual lot or parcel within <br />a calendar year. <br />(d) The adjustment will result in less than a 200% change in the size of the lot or <br />parcel. <br />(2) A property line adjustment application may not be utilized to effect the <br />reconfiguration of lots or parcels which must be approved through the partition or <br />subdivision procedure. <br />(3) A property line adjustment application may not be utilized to create flag lots. <br />[Comment: Addition ofsubsection (3) avoids possible interpretation questions.] <br />9.8410 Property Line Adjustment Application Requirements. In addition to the provisions <br />in EC 9.7010 Application Filing, the following specific requirements shall apply to <br />property line adjustment applications. <br />(1) Except for parallel property line adjustments, all applications shall be prepared by <br />an Oregon licensed Land Surveyor. <br />(2) Applications shall be signed by at least one of the owners of each parcel involved, <br />and shall include a preliminary title report for each parcel. <br />9.8415 Property Line Adjustment Approval Criteria. The planning director shall approve, <br />approve with conditions, or deny the property line adjustment application. Approval or <br />approval with conditions shall be based on compliance with the following criteria: <br />(1) Any buildings to be retained on the properties comply with the minimum front and <br />February 2001 Draft Land Use Code (legislative version) - 377 0 0 0 L 0 8 <br />02/08/01 <br />
