INTRODUCTION <br />The Hearings Official conducted a public hearing for the Alder Woods PUD (PDT 07-5 & SDR 08-2) <br />tentative planned unit development and standards review request on May 14, 2008, which was continued <br />to July 23, 2008. Following the end of the public 'nearing and closure of the public record, the Hearings <br />Official granted conditional approval of the applicant's tentative planned unit development request <br />without standards review approval on September 10, 2008. On September 23, 2008, an appeal of the <br />decision was filed by the applicant's representative, Bill Kloos, Law Office of Bill Kloos, PC. The appeal <br />is comprised of 16 appeal issues, of which the appellant has clarified only 12 are intended as assignments <br />of error "on the table" to be addressed by the Planning Commission, as reflected in the appellants written <br />statement and supplemental appeal responses, and further addressed in the findings and conclusions <br />provided ,el ow. <br />The Planning Commission held a public hearing on this appeal on October 14, 2008. After the public <br />hearing was closed, the Planning Commission deliberated the appeal issues at its meetings on October 20 <br />and October 27' 2008 before taking fin-al action on the appeal. The appeal is based on the record and <br />limited to the applicable assignments of error contained in the appeal statement submitted. <br />ai. Significant on-site vegetation, including rare plants (those that are proposed <br />for listing or are listed under State or Federal law), and native plant <br />communities. <br />b. All documented habitat for all rare animal species (those that are proposed <br />for listing or are listed under State or Federal law). <br />C. Prominent topographic features, such as ridgelines and rock outcrops. <br />d.
