pursuant EC 9.6500 Easements to address Public Works facilities. Public Works staff further confirms <br />the proposed PUD will otherwise comply with the easement requirements of EC 9.6500 and related <br />standards, subject to further review as part of the subdivision process. However, staff notes that the <br />proposed PUEs, particularly the 5-foot public easement along the north side of Nelson Street, may not <br />be sufficient to accommodate Eugene Water and Electric Board (EWEB) facilities. <br />EC 9.6505 Improvements -Specifications requires that all public improvements to be designed and <br />constructed in accordance with adopted plans and policies, and shall make and be served with an <br />adequate water supply and infrastructure complying with applicable standards as set forth in Chapter <br />6, 7 and 9 of the Eugene Code. <br />The proposal includes public streets, storm drainage and wastewater systems that are to be privately <br />engineered and constructed. While staff generally supports the proposed public improvements design <br />on a conceptual level with the exception of the proposed culvert crossing, design details and <br />engineering details have not yet been evaluated. These will be subject to review and approval by the <br />city Engineer after review of the design and supporting analysis prepared by applicant's engineer in <br />accordance with procedures in Eugene Code Chapter 7 for privately engineered public improvements. <br />Public Works staff notes an Engineering and Construction agreement will be required for the private <br />construction of public improvements and must be submitted when the construction plans are submitted <br />for review and approval as a condition of tentative subdivision approval. Prior to PEPI approval, the <br />applicant shall provide a concurrence to the wetlands delineation and if the improvements impact <br />delineated wetlands, and obtain Oregon DSL and Army Corps of Engineer Fill Permits for any <br />wetland areas that will be impacted by public improvements. If the public improvements have not <br />been permitted prior to final plat approval, a bond for the construction of public improvements will be <br />required. As confirmed by Public Works staff, to reduce repeated and unnecessary disruption of the <br />channel, all of the construction activities associated with the crossing and underground utilities must <br />be reviewed under a single PEPI permit. <br />With regards to EC 9.6505(1) Water Supply, comments from EWEB staff indicate that water service <br />for the proposed development will be provided in accordance with EWEB policies and procedures. <br />EWEB referral comments note that water service is available from an 8-inch ductile iron water main <br />located on the west side of Sterling Woods Drive and from an 6-inch cast iron main on the west side of <br />Gilliam Road. Referral comments further indicate that a water main extension will be required to serve <br />the development and that any new water facilities will be located in the right-of-way or in a minimum <br />7-foot wide easement adjacent to the right-of-way or in a minimum 14-foot easement where not <br />adjacent to public right-of-way. Private utility easements are required to provide service to cross one <br />lot for the benefit of another. The site plans do not show private utility easements over Tract A for the <br />benefit of Lots 5 and 6 and those easements will be required to be depicted before those lots can be <br />developed. Documentation that EWEB has received a financial guarantee ensuring that water will be <br />provided to each lot will be required prior to final subdivision approval. <br />As previously noted, the private water lines to Lots 5 and 6 are located within the /WR conservation <br />area and are subject to SDR approval. A modification to the final PUD to permit development west of <br />the eastern riparian corridor will require a demonstration that the utility connections must be extended <br />across the riparian corridor and that the installation of those utilities is consistent with SDR standards. <br />With respect to sewage facilities, the applicant indicates that the proposal will connect all lots to an <br />existing 12-inch wastewater line in the Sterling Woods Drive stub. As shown on the site plans, 8-inch <br />public wastewater lines are proposed within the subdivision.
