The hearings official understands that soil moisture and shrink/swell conditions can be addressed by <br />adding structural fill or by instituting special development standards. The applicant has proposed to <br />place structural fill on at least some of the development sites, and there is no evidence of soil stability <br />hazards that would preclude development of the site or pose a significant risk to public health and <br />safety. The hearings official therefore concludes that it is feasible to satisfy this standard by requiring <br />the submission of a geotechnical report that describes existing conditions, development constraints and <br />recommendations to assure safe development prior to tentative subdivision approval, and by <br />conditioning development to require compliance with those development recommendations. <br />Referral comments from the Fire Marshal's Office do not indicate any concerns with regard to <br />emergency response. <br />Based on the findings presented above and as conditioned, the hearings official concludes that this <br />standard is satisfied. <br />EC 9.8320(7) Adequate public facilities and services are available to the site, or if public services <br />and facilities are not presently available, the applicant demonstrates that the <br />services and facilities will be available prior to need. Demonstration of future <br />availability requires evidence of at least one of the following: <br />(a) Prior written commitment of public funds by the appropriate public agencies. <br />(b) Prior acceptance by the appropriate public agency of a written commitment by <br />the applicant or other party to provide private services and facilities. <br />(c) A written commitment by the applicant or other party to provide for offsetting <br />all added public costs or early commitment of public funds made necessary by <br />development, submitted on a form acceptable to the city manager. <br />Adequate public facilities and services are presently available and can be extended as necessary to <br />serve the proposed development. EC 9.8320(7) is satisfied. <br />EC 9.8320(8) Residents of the PUD will have sufficient usable recreation area and open space that <br />is convenient and safely accessible. <br />The proposed PUD incorporates single-family residential lots with small yards and public streets with <br />suitable pedestrian and bicycle circulation and access to the undeveloped park site south of the <br />proposed development and to nearby bicycle paths. Staff asserts that proposed lots 5 and 6 have do not <br />have adequate usable space on-site, in part because of the significant development constraints posed by <br />the /WR overlay standards. The hearings official concludes that the overall density of development on <br />the site, coupled with its proximity to a city park provides sufficient usable recreation areas and open <br />space for the residents of the development.
