1 <br />Pursuant to EC 9.6805, the city may require dedication of public ways for bicycle and pedestrian use <br />and for streets and alleys, provided the city makes findings to demonstrate consistency with <br />constitutional requirements. EC 9.6805 further provides that rights-of-way for streets to be dedicated <br />to the public by the applicant shall conform to the adopted street right-of-way map and EC Table <br />9.6870. EC 9.6870 establishes that the right-of-way and paving width for streets and alleys dedicated <br />shall conform to those designated on the adopted street right-of-way map and, in cases where there is <br />no designated width, the width shall be the maximum shown for its type in Table EC 9.6870, unless a <br />lesser width is approved by the Planning and Public Works Directors based on adopted plans and <br />policies, adopted Design Standards and Guidelines for Eugene Streets, Sidewalks, Bikeways and <br />Accessways or other factors which in the judgment of the Planning and Public works director allow for <br />a lesser street width. <br />In response to the dedication requirements at EC 9.6805, the applicant proposes to dedicate all <br />proposed streets to the city. With respect to the street width for the proposed streets, Public Works <br />staff confirms that the proposed streets are not identified on the street classification and right-of-way <br />maps and are appropriately classified as low volume residential streets based on estimated 250-750 <br />Average Daily Trips (ADT). With respect to street width, EC Table 96870 establishes a 45-55 foot <br />right-of-way and a 20-28 foot paving range for low volume residential streets' <br />The applicant is proposing to construct Nelson Street with 28 feet of paving within a 55-foot right-of- <br />way, which is consistent with the maximum established at EC 9.6870. For Sterling Woods Drive and <br />Nelson Court, the applicant is proposing 21 feet of paving within a 45-foot right-of-way. Although <br />the proposed 45-foot right-of-way and 21-foot paving widths are not consistent with the maximum <br />widths established for low volume residential streets, the Public Works and Planning Directors <br />conclude that a lesser width is warranted given that the proposed widths meets the minimum <br />requirements for low volume local residential streets as established in EC Table 9.6870 and EC <br />9.6505(3)(b), are adequate to safely accommodate traffic within the proposed street layout, and are <br />otherwise consistent with the Table 1 Arterial and Collector Street Standards and Table 2 Local Street <br />Standards of the adopted Design Standards and Guidelines for Eugene Streets, Sidewalks, Bikeways <br />and Accessways. <br />The segment of Gilliam Road that abuts the subject property is not identified on the city's adopted <br />street classification or right-of-way maps and functions as a medium-volume residential street. It is <br />partially improved with a 21-foot paving width within 40 feet of right-of-way, with 10 feet east of <br />centerline. Gilham Road is under Lane County jurisdiction but is maintained by the city. Pursuant to <br />EC 9.6870, medium-volume residential streets must have between 20 and 34 feet of paving within 50 <br />to 60 feet of right-of-way. Because the segment of Gilham Road abutting the subject property is not <br />designated on the adopted street right-of-way map, pursuant to EC 9.6870, the required street right-of- <br />way width for the segment of Gilham Road abutting the subject property is 60 feet. <br />The applicant's site plans show the segment of Gilliam Road abutting the subject property as <br />consisting of 50 feet of right-of-way, with 30 feet from the centerline directly abutting the subject <br />property and 20 feet from the centerline east of the subject property. As noted above, Gilham Road <br />directly abutting the subject property and has 40 feet of right-of-way, with 20 feet on both sides of the <br />centerline. To meet the minimum right-of-way standard, the applicant is required to dedicate the 10 <br />feet of right-of-way along the entire plat boundary of the subject property abutting Gilham Road (as <br />that right-of-way is shown on the applicant's tentative plan).
