PDF Page 103 <br />The building permit submittal shall include sufficient detail to verify that-no more <br />than 30 percent of the critical root zones of trees to be preserved will be impacted <br />by construction activities on the lot, or a report be a certified arborist verifying that <br />the proposed construction activities can otherwise be conducted in a manner that <br />does not threaten the survival of the trees to be preserved or a report by a certified <br />arborist with mitigating measures to preserve the affected preservation trees. Each <br />building permit shall include tree protection fencing to be erected at the perimeter <br />of the critical root zones for all trees to be preserved (or an alternative location as <br />approved and documented by a certified arborist and the City. (See Hearing Official <br />Decision (The Jewel) PDT 08-1 (October 24, 2008). <br />e. At the time of building permit review,.trees designated to be preserved on private <br />lots shall be identified and marked in the field for verification of tree preservation <br />prior to issuance of building permit. (See Hearing Official Decision (Spring Knoll PUD <br />Phase 4) PDT 05-3 (November 17, 2005). <br />f. Protective fencing for trees identified to be preserved shall be inspected and <br />approved by the City prior to beginning and construction related activities. All <br />protective tree fencing shall remain in place until issuance of Final Occupancy permit <br />or until completion of all construction activities, whichever comes later. (See Hearing <br />Official Decision (The Jewel) PDT 08-1 (October 24, 2008). <br />g. The removal of diseased or hazardous trees is allowed with prior approval by a <br />certified arborist and documentation of that approval and the need for removal <br />provided to the City. Trees to be preserved may not be considered hazardous based <br />on design or location of proposed residence or site improvement which would <br />render the tree a future hazard. (See Hearing Official Decision (The Jewel) PDT 08-1 <br />(October 24, 2008). <br />h. In-the event a diseased or hazardous preservation tree must be removed, it shall be <br />replaced at a ratio of 2 trees for 1 preservation tree removed. Replacement trees <br />shall be native species with a minimum caliper of 1 for deciduous trees and a <br />minimum height of 5' for coniferous trees. (See Hearing Official Decision (The Jewel) <br />PDT 08-1 (October 24, 2008). <br />All structures and any at-grade site improvement, including but not limited to <br />driveways, paved surfaces, decks, patios, and retaining walls, shall be setback a <br />minimum of 5 feet-from protective tree fencing boundaries to allow for normal <br />construction activities to occur between building foundations/paved areas to be <br />protected from impacts, Additional setbacks may be necessary to prevent <br />construction activities from impacting protection areas and trees designated for <br />preservation. No activity shall encroach within the fence area.
