regarding the capacity of the public wastewater system serving this area. Stormwater <br />conveyance and capacity, as well as street standards, will be further evaluated at the time of <br />development. <br />Based on these findings, the criterion is met. <br />EC 9.8865(4): The proposed zone change is consistent with the applicable siting <br />requirements set out for the specific zone in: <br />Under the list of applicable siting requirements in EC 9.8865(4), it appears that the only potentially <br />applicable standard is set out in subsection (d): <br />(d) EC 9.2610 Park, Recreation, and Open Space Siting Requirements <br />(1) Rezoning the subject site implements park, recreation, open space, or natural <br />resource preservation objectives and policies; or <br />(2) The subject site is privately owned, at least 2 acres in size and meets the purpose <br />of this zone and the definition for non-publicly owned open space in EC 9.2620 <br />PRO Zone Terms. <br />(3) The PRO zone shall not be applied to an area on the city's acknowledged Goal 5 <br />inventory unless it is determined that any change in the level of protection <br />afforded the resource by the PRO zone is consistent with the acknowledged level <br />of protection for the resource. <br />The subject property meets the siting requirements of subsection (2), as the subject site is <br />privately owned and much larger than 2 acres. The purpose of the PRO zone, which includes <br />providing recreational opportunities and preserving areas with scenic and natural habitat value, <br />is also fulfilled with the proposed designation. More specifically, the subject site includes forest <br />lands and a ridgeline that could provide for scenic trail systems to be used by residents for <br />hiking, mountain biking, and other recreation. Finally, the subject site meets the definition of <br />non-publicly owned open space. <br />Goal 5 resources exist on the subject site. As noted above, the applicant is retaining the Water <br />Resources /WR overlay zone over the entire site, which will implement the Goal 5 protection <br />measures adopted by the city. <br />Based on these findings, the criterion is met. <br />EC 9.8865(5): In cases where the NR zone is applied based on EC 9.2510(3), the property <br />owner shall enter into a contractual arrangement with the City to ensure the area is <br />maintained as a natural resource area for a minimum of 50 years. <br />This criterion does not apply as the proposed zone change does not include the NR zone. <br />Laurel Ridge (Z 15-5) August 2015 HO Agenda - Page 2 <br />Laurel Ridge Record (Z 15-5) <br />Page 767 <br />
