curves of the UGB line depicted on the Metro Plan Diagram are similar to the shape <br />and curves of the UGB line established in the 2007 annexation decision." <br />Staff agrees that 30th Avenue is a superior referent, but also believe that the UGB could be a <br />useful referent in this case to help determine the boundary between proposed R-1 and PRO <br />zoning. Staff encouraged the applicant to utilize this referent in their proposal. However, the <br />applicant has declined to do so, as of this writing. <br />Despite the lack of additional referents that could be utilized, staff has evaluated the proposed <br />zoning configuration proposed by the applicant compared to the configuration as represented <br />on the currently adopted 2004 Metro Plan Diagram (11"x17"). Staff ultimately concludes that <br />this proposal provides a reasonable representation of the Metro Plan Diagram. <br />As noted earlier, testimony from Gunnar Schlieder, a representative for the Laurel Hill Valley <br />Citizens (LHVC) group, refutes the applicant's proposal. This written testimony was received <br />late in the preparation of this staff report, so staff has not had an opportunity to review it in <br />detail. However, Mr. Schlieder believes the applicant's proposal should be denied for the <br />following reasons: <br />• The Metro Plan diagram is aligned to "Grid North of the State Plane Coordinate System," <br />while the tax lot map is aligned to "True North." In effect, this caused error when the <br />applicant overlaid the "tax lot layer" on the Metro Plan diagram. <br />• At the western extent of the applicant's proposed designation map (Sheet Z C-4), the <br />surveyed 30th Avenue strays from 30th Avenue as portrayed on the Metro Plan diagram. <br />This indicates an error in the applicant's methodology that affects their proposed zoning <br />configuration. <br />• LHVC's version of the proposed zoning map is more accurate because ALL streets <br />present on the Metro Plan diagram were used as referents. <br />Metro Plan Policy: The Metro Plan includes the following policies that generally support the <br />proposal: <br />➢ PolicyA.2: Residentially designated land within the UGB should be zoned consistent with <br />the Metro Plan and applicable plans and policies, however, existing agricultural zoning <br />may be continued within the area between the city limits and the UGB until rezoned for <br />urban uses. <br />In 2007 the subject properties were annexed into the City of Eugene, and are being rezoned to <br />a residential zone consistent with the policy above. <br />Policy C21: When planning for and regulating development, local governments shall <br />consider the need for protection of open spaces, including those characterized by <br />significant vegetation and wildlife.
