COM <br />Joint Planning Commissions of Lane County, Springfield, Eugene <br />Re: Metro Plan Enabling Amendments <br />Dear Commissioners: <br />Please accept this letter on behalf of my client, Environ-Metal Properties, LLC, which owns a <br />large tract of land in the city, adjacent to the UGB on 30th Ave., east of Spring Boulevard. My <br />client, for the past few years, has been in the process of getting this land annexed and zoned <br />consistent with the Metro Plan. <br />In connection with our first rezoning efforts, the City of Eugene determined that the Metro Plan <br />Diagram controls over the refinement plan diagram at this location, and that a portion of the <br />property is plan designated Parks and Open Space. See Environ Metal Properties, LLC v. City of <br />Eugene, Or LUBA (LUBA No. 2013-098, Jan. 1, 2014), aff'd without opinion 263 Or App <br />714 (A156190, June 11, 2014). <br />We are preparing a new zone change application based on the Metro Plan Diagram adopted in <br />2004, as part of the 2004 "Housekeeping Amendments." The plan designations shown on that <br />official diagram are now the only lawful diagram touchstone for requesting zoning. <br />The Metro Plan Diagram included in your materials is different than the official 2004 Diagram <br />for my client's property. That is, it shows a greater part of my client's property being Parks and <br />Open Space than does the officially adopted 2004 Metro Plan Diagram. The City may not <br />change the plan designation of my client's property as part of the amendments that are before <br />you now. But, if you adopt the Diagram that is before you now, that is what will happen. <br />So, something is amiss here. The only plausible explanation is that LCOG, the holder and printer <br />of the official Metro Plan Diagram, has printed out the Diagram in a different fashion than was <br />done for the version that was printed in 2004 and adopted by ordinance. There is only one <br />official, lawful version of the Metro Plan Diagram. That is the Diagram printed in 2004 and <br />adopted by the Housekeeping Amendments Ordinance.
