Mr. Fred Wilson <br />September 16, 2015 <br />Page 5 <br />designations are depicted over a single-line representation of major streets <br />and roads." <br />(c) The governing bodies in 2014 confirmed the primacy of the 2004 printed <br />Diagram when they almost goofed in the HB 3337 amendments. <br />Recently, in Metro Plan amendments to effectuate the HB 3337 split, the three <br />governing bodies affirmed the primacy of the 2004 printed Diagram as the only <br />legitimate Metro Plan Diagram. The applicant alluded to this at the hearing, and then <br />submitted documentation during the open record period. <br />In November 2014 the three governing bodies adopted identical amendments to the <br />Metro Plan intended to facilitate the transition to separate UGBs. The county <br />ordinance was PA 1313 (Nov. 12, 2014). It has been submitted post-hearing as part <br />of Exhibit S at page 4. The Joint Planning Commissions met on the matter on <br />October 23, 2014. Their approved minutes have been submitted as part of Exhibit S at <br />page 182. The minutes reflect that the draft ordinance included, in addition to the <br />plan text amendments, a Metro Plan Diagram. The minutes reflect submission of <br />testimony by Bill Kloos, on behalf of Environ-Metal, objecting to the Diagram, <br />because it differed from the 2004 Metro Plan Diagram in material respects, including <br />relating to the Environ-Metal property. The Kloos letter of testimony has been <br />submitted as part of Exhibit S at page 189. The material part of the minutes says: <br />"Bill Kloos, Oregon Land Use Law, Eugene, spoke on behalf of his client <br />Environ-Metal Products, LLC. He noted he had submitted a letter dated October <br />22, 2014, to the Joint Planning Commission setting forth his concerns regarding <br />the Metro Plan enabling amendments. He said the proposed Metro Plan Diagram <br />map was wrong as it was not based on adopted 2004 Metro Plan Diagram, but <br />rather on a version generated by Lane Council of Governments (LCOG) that was <br />printed in a different manner than the official version. He thanked staff for their <br />recommendation to remove the maps." <br />"Mr. Kloos expressed concernthat it was not possible to access online an accurate <br />copy, including site-specific amendments, of the official 2004 Metro Plan <br />Diagram. He said maintaining an accurate Metro Plan Diagram that was <br />accessible to the public was a long-standing problem. <br />"In response to a question from Mr. Peterson, Ms. Davies said that removing the <br />proposed Metro Plan Diagram from the proposed amendments meant that the <br />2004 adopted version would still be in effect." <br />The matter then moved to the governing bodies. The October 30, 2014, Staff Report <br />to the County Board confirmed removal of the Metro Plan Diagram from the plan <br />amendment ordinance because staff had confirmed that the version of the Diagram <br />Laurel Ridge Record (Z 15-5) Page 52 <br />
