Attachement E <br />3. Attend the public hearing on July 14, 2015 and state your concerns. Your spoken testimony will be <br />recorded. The Planning Commission may limit the time for each speaker to a few minutes. You are <br />encouraged to submit written testimony if you have detailed comments you wish to make. <br />You may also state your opinion to your neighborhood group. To contact the neighborhood group, call <br />the Neighborhood Liaison Office at 682-6243 or visit the website at: www.eugene-or.gov/neighborhoods <br />All testimony received by the Planning Division will also be forwarded to the City Council; Council will <br />hold a subsequent public hearing following the Planning Commission's recommendation, before any <br />final action is taken on the request. Issues which may provide the basis for an appeal to the Oregon Land <br />Use Board of Appeals must be raised by the person testifying not later than the close of the record at or <br />following the final evidentiary hearing on the proposal. Such issues shall be raised and accompanied by <br />statements or evidence sufficient to afford the Planning Commissioners, elected officials and parties <br />involved an adequate opportunity to respond to each issue. <br />Failure to raise an issue with sufficient specificity to afford the decision-maker and the parties involved <br />an opportunity to respond precludes appeal to the Oregon Land Use Board of Appeals (LUBA). All <br />decisions of the elected officials are final. A party may appeal the decision to LUBA within 21 days of the <br />decision of the elected officials. Appeals to LUBA are governed by ORS 197.830 to 197.845. <br />At the public hearing, testimony will first be accepted from the applicant and those in support of the <br />request, then from those that are neutral, then from those in opposition. The applicant will also be <br />given an opportunity for final rebuttal. Following the public hearing, the Planning Commission chair will <br />announce whether the record is closed, held open for a specified period, or continued to a specific time <br />and place. If a participant requests an additional opportunity to submit testimony, the City will <br />accommodate that request by holding the record open for more written testimony or continuing the <br />hearing on another date. <br />The City of Eugene complies with state and federal laws and regulations relating to discrimination, <br />including the Americans with Disabilities Act of 1990 (ADA).
