Attachment B <br />of rezoning. <br />Based on the above, the adopted refinement plan is either not applicable or the proposal is <br />consistent. <br />(3) The uses and density that will be allowed by the proposed zoning in the location of the <br />proposed change can be served through the orderly extension of key urban facilities and <br />services. <br />The findings of compliance with Goal 11- Public Facilities and Services, and Goal 12 - Transportation <br />above are incorporated herein by reference. With the findings established and referenced herein, <br />the proposal complies with this criterion. <br />(4) The proposed zone change is consistent with the applicable siting requirements set out for <br />the specific zone in: <br />(f) EC 9.2735 Residential Zone Siting Requirements. <br />There are no applicable siting requirements for the R-1 zone; therefore, this criterion does not apply. <br />(5) In cases where the NR zone is applied based on EC 9.2510(3), the property owner shall enter <br />into a contractual arrangement with the city to ensure the area is maintained as a natural <br />resource area for a minimum of 50 years. <br />The NR zone is not requested or applicable in this instance. Therefore, the above criterion is <br />inapplicable. <br />Zone Change Conclusion <br />Based on the above findings, compliance with the zone change approval criteria of EC 9.8865 is met. <br />Findings - 12 <br />PC Agenda - Page 18 <br />
