Oakleigh Lane could be an eight-foot-wide, four-wheel drive, dirt track, and the <br />proposed PUD would satisfy the requirements of EC 9.8320(5) and (6). <br />Look at the accompanying videos of the Oakleigh Lane families and kids who live on <br />Oakleigh Lane, and who must walk and bicycle in the roadway, and ask yourselves <br />whether this twisting of the law serves the Eugene Code's overarching purpose "to <br />protect and promote the health, safety, and general welfare of the public." <br />• Relying on a conclusory statement in the Public Works report- regarding only the <br />requirements in EC 9.8320(11) for paving - that "Oakleigh Street will continue to <br />adequately provide for motorized and foot traffic, as well as for emergency vehicles and <br />delivery services, provided the paved surface is not blocked by parked vehicles." <br />And yet, as has been clearly demonstrated, even before my testimony - Oakleigh Lane is <br />and will be obstructed by parked vehicles, including ones parked legally. <br />The applicant's attorney and the Deputy City Attorney want commissioners to ignore <br />this explicit condition stated in the Public Works report. But you cannot do that lawfully. <br />THE "THIRD ELEPHANT" - APPLICABLE EMERGENCY RESPONSE STANDARDS <br />Here is the third elephant in the room that the applicant and city staff chose to ignore - adopted <br />Eugene Fire Code. <br />As I will walk you through presently, Eugene Fire Code requires several things for the public <br />safety, which are directly applicable to the failure of the application to meet the requirements of <br />EC 9.8320(5) and (6): <br />The new buildings in the proposed PUD must be served by fire apparatus access road - <br />"[a] road that provides fire apparatus access from a fire station to a facility, building or <br />portion thereof. (Emphasis added.) <br />In this case, the entirety of Oakleigh Lane must be part of that fire apparatus access road. <br />2. "Facilities, buildings or portions of buildings hereinafter constructed shall be accessible <br />to fire department apparatus by way of an approved fire apparatus access road with an <br />asphalt, concrete or other approved driving surface capable of supporting the imposed <br />load of fire apparatus weighing at least 80,000 pounds." <br />3. "The number of dwelling units on a single fire apparatus access road shall not be <br />increased unless fire access roads will connect with future development...." (Italics in <br />original.) <br />4. The fire apparatus road "shall be in accordance with this appendix [defining standards] <br />and all regulations and standards adopted by the City of Eugene." <br />5. "Fire apparatus roads shall have an unobstructed width of not less than 20 feet, <br />exclusive of shoulders...." <br />6.
