Testimony re ZC 15-5, page 2 <br />How this happened is pretty obvious. When you align two lines as the applicant did when they aligned the <br />survey-located 30th Avenue centerline on their tax lot map with the black line representing 30th Avenue on <br />the Metro Plan Diagram, you can slide them back and forth along each other as convenient. In the applicant's <br />case they slid their tax lot in a northwesterly direction along the representation of 30th Avenue on the Metro <br />Plan Diagram. Had they stopped when the blue dotted line on their tax lot map reached the actual location of <br />the city boundary to the east of Spring Blvd. on the Metro Plan Diagram, it would be an entirely different map. <br />In fact it would look remarkable like map SA 7.0 - SITE ANALYSIS: LAND USE AND INFRASTRUCTURE (copy <br />attached) that was submited by the applicant as part of a zone change request back in 2013. <br />[Show SA 7.0] <br />So why does this matter? For the applicant it matter a great deal, it reduces the portion of their property that <br />the Metro Plan Diagram designates as Parks and Open Space from about 40 acres, as shown of SA 7.0 to about <br />20 acres in their current application. For taxlot owners along Spring Blvd., part of their taxlot may now be <br />outside of city limits, and they may be entitled to a tax refund from the City. <br />The bigger picture is that no property owner should be allowed to redraw a community's boundaries to benefit <br />themselves. <br />We ask for the following remedy: First, that you deny the Zone Change Application Z 15-5. Second, that you <br />direct the applicant to contract with LCOG to determine the correct registration between the Metro Plan <br />Diagram and the tax lots in the vicinity of of the applicants property. LCOG has decades of experience with <br />geographic data systems, and are generally recognized as the experts when it come to generating maps for <br />public purposes. <br />In summary, it is clear that the applicant has placed their tax lot in the wrong place on the Metro Plan Diagram. <br />Other speakers will present additional evidence that this is so.
